You are right. Distance is an advantage. He is here now but cannot leave until AP is approved (so it doesn't matter). As for the visa, it is the SAME process for everyone. We too had a very stressful (K1) visa process. He did NOT come here illegally or has ever been here illegally. Yes, it was easier to go see him (I guess) because I did not have to fly 24 hours. Time and money was still spent and exhausted. :rolleyes:

They say it is the same process for everyone, but we know it is not always true. I'm sure there is a lot more going on behind adjusting someone from Saudi Arabia than there is to adjust a brit or a japanese person... but the OP was talking about distance.

You are also correct, florida_guy07, the process is not the same for everyone, especially with the communist countries in Asia or the countries in Middles East. Vietnam is the most difficult and busiest visa center in Asia, we have to wait for nearly one year to complete our visa process, however, we are still the lucky ones. There are a lot of other Vietnamese couples are waiting for years. The visa process on my country is such as a "nerver war".

Hey, Hien makes a point, Mexicans bypass most State laws. Like hell they are the same as us overseas folk. Canadian folks have it even easier, mainly because they're white and can easily hide. You can DRIVE to Mexico, all you need is an ID, passports are not needed as of yet. ID's can be gained through a passport, foreign license, and birth cert. Try loading a plane and crossing an ocean, don't make the comparison between intercontinental immigrants and overseas folks. I guarantee there are more illegal Mexicans and Canadians than there are Vietnamese residing in the States. Mexicans actually get special treatment for being illegal, it's amazing.

Mexicans actually get special treatment for being illegal, it's amazing.

What is the "special treatment" that they get that I am not aware of? Granted there may be many illegal hispanics (yes they all get called Mexicans regardless of where they are from), but I was not aware of any special treatment that is specifically for illegal Mexicans. Please enlighten me.

I really had to inject this in here: The US really is not the richest country in the world...sorry dudes and gals! It's quite a BIG country, lots of land mass etc. However with the government spending how many trillion now (?) on the war, national debt is at it's highest ever - um, by a long, long shot. Assets minus debt = staggeringly poor amount of gold left in Fort Knox that doesn't belong to someone else... Really, the US simply has the biggest debts now. Bit like Michael Jackons really - he had lots of money in his heyday, but nowadays he's hiding out, and he's broke...

Scared yet? :D

I am NOT here to argue, I didn't even read all of the post, but I can say that illegal Mexicans do NOT get special treatment. I am a teacher in a school where the majority of students are Mexican (probably most are illegal). They have it rough here. It's sad because they are children and most grow up here, yet because they don't have papers, life is a lot harder.

I don't want to discuss this though because I have a question about the interview - I just wanted to say that.

In your opinion, is the AOS interview similar to the K1 interview? Is it more work to do to prepare?

It may be hard to give a general answer...so, was your AOS interview a lot different from the K1/K3 interview you had?

Power ='s wealth. Assets's = wealth. Sure we owe a ton of money to other countries, but, hey, it's not like we'll ever pay that debt back, everyone knows that. Plus look at our oil reserves, Bush won't touch those until oil's worth $30 a gallon. The fact is that America will always be the richest and most powerful country on the Earth; only nuclear warfare will stop that. As for the Mexicans, we give them many benefits, both sending money back to Mexico with no ID or SSN and the jobs that USC's won't take themselves are just a few of those perks...Anyone remember the protests last year in LA? What I'm getting at is that Mexico, because it's a bordering, poor country, gets special treatment because it's inevitable that Mexican citizens WILL cross the border illegally. The US government plans for that...that is if we don't shoot them in the back while they run away from border patrols back into their country. Oh, but even with that, give the guy immunity, give him a green card to testify. So, comparing Mexican and Canadian citizens to oversea immigrants is equivalent to apples and oranges.

by the way, we're the third richest country.

While I agree with you that the guy should not have received immunity for testifying, not all Mexicans have the same beliefs. I do not agree with all the protests. They are rediculous. Illegal is illegal, no matter who it is. My husband and I were apart a year while we were doing this whole immigration process. He will be the first one to tell you that everyone should follow the correct course. He was originally here on a work visa and left BEFORE it expired because he feared being out of status. We have done everything by the book! We waited like everyone else. We were fortunate that the K1 was complete in 4 months, but others here on VJ going through the same consulate have not been as lucky. There is only ONE consulate which handles K1 interviews and they come from all over the country for the interviews. Some have been waiting close to a year (if you have RFE's it only prolongs it more). Many of us here on VJ are here doing the same thing as everyone else.... trying to get our loved ones here. I hate to see anyone single out any group (Mexican or Canadian). Don't forget why we are all here on VJ...to learn and help each other.

I just noticed that I have yet to read any posts about people actually failing their interview, AOS process. Does this happen or are there a ton of appeals that make it virtually impossible?

It is possible. Our first AOS was denied. (This was because of us, not USCIS). I would guess that most denials are a result of either relationship problems or unprepared applicants.

After a denial, you can either appeal or apply again in most cases. Applying again is good because it is a fresh slate. An appeal may not always work (then you would need to apply again anyway). The advantage of an appeal is keeping your EAD. (you need to apply for it again with a new application). Cost is about the same.

Lawyers probably recommend appeals more than they should, since they are more expensive and generally require more help from lawyers. It might look better in court as well, if things get ugly.

If your marriage is otherwise happy, a denial is not a big deal. Apply again - it is just more time and money.

Our second AOS was approved less than 90 days after mailing it.
