Name change on AOS interview

Got my EAD so I went to SSA to apply for SS number. My EAD is on my maiden name since when I filed my I-485 together with my I-765 I used my maiden name because that time we didn't know that I can already use my husband's last name. So when I went to SSA, I asked the SSA employee if I can use my husband's last name. He asked for my marriage license, passport, EAD and birth certificate and then told me I can and advised me to have my EAD changed also. But we told him we'll have our AOS interview next month and we will have it handled. Now my concern is will I be able to change my maiden name to married name during my AOS interview so that my green card will be on my married name too? I've read from other sites that some were able to do so. Just that I am worried. Any help will be greatly appreciated.

Yes you can have your name changed at the AOS interview, I assume you already have a date for the interview?

 

I don't know what visa you arrived on but many who arrive on a K-1 get their interviews waived, which means you can't change your name at any interview as you won't have one. But if you already have a date for the interview then you're good to go. Just bring your marriage certificate (and everything else they ask for) and let them know you want your married name on the greencard.

Thank you for the reply. I arrived on a K-1 visa. And yes I do have a interview date, which is on June 7th. Your reply really means a lot since I am so worried I wont be able to change it. Now I'm relieved lol. I will definitely bring my marriage cert and SS card too as proofs. Thanks a lot

Yes, I was able to change it. Just make sure you let them know during your interview.

I find this site very helpful that's why I haven't turn off my notifications especially I will have to apply for the removal of my conditional green card soon.

I had a related question - if you did not do a name change on the marriage certificate/when getting married, can you still request at the AOS interview to do the name change to your spouse's last name?

Hi, sorry to come into this but I was just wondering how you eventually resolved this issue? I’m in the same situation, I only put my maiden name on my adjustment of status paperwork as well as paperwork for the employment authorisation etc. I have my biometrics appt Tuesday so wondering whether to now put my new name on that paperwork or if there’s anyway to notify them or if I’m stuck now? 
 

Any help would be appreciated!

Is there a reason that you filed in your maiden name? Did you want to keep your maiden name?

 

No, you have to fill out the form you receive at your biometrics appointment in the name that is on the biometrics letter (ie the letter USCIS sent you). You can't change anything at the biometrics appointment, all they do at the ASC offices is taking fingerprints/photos/signatures.

 

You can ask the IO at the actual interview to change your name in the system so your greencard comes in your married name.

I did it accidentally, I didn’t realise that the marriage certificate in itself was enough to change my name so I was still filing everything in my old name. I wish I had know at the time. I do want to change to my married name. 
 

oh okay thank you, so am I correct in thinking this will mean my EAD etc will be in my maiden name and I assume there’s no other way I can change this? That would be okay in the meantime as long as I can get it changed before I actually receive my green card. Thank you for getting back to me!

You can try to send NBC (National Benefits Center, they're dealing with EAD and AP) a letter asking them to have your name changed on your EAD. I did that one time. 

 

Write a letter and explain the issue, write current name and the name you want to change to. Also write your A-number and receipt number. Include a copy of your marriage certificate as proof of name change.

 

It's not a guarantee or anything, but then you at least tried.
