Hello everyone,

Unfortunately My fiancée got into a car accident one day before I entered the USA and she is admitted in the hospital and would likely to be admitted in the hospital for more than 3 months :(:( and I want to ask how we should get married if we cannot attend the court. 

Ps: My fiancée(the petentioner) lives in Portland Oregon

you are already here, right? if so, you can call a justice of the peace to marry you at the hospital

 

so sorry for your situation and hope your fiance feels better

 

It won't be a romantic wedding, you can do that later, being legally married within the 90 days is what's important

 

now if you want to wait until he gets well, then instead of adjustment of status under the k1, you will file the spousal visa, including the i130

Thank you so much for replying, and yes I am already here with her at the hospital, and will I get the marriage certificate right away or will It take few days to process? And why do I need to file the i130 instead of adjustment of status?

Sorry for what you are going through and best wishes for a speedy recovery for your fiancée.  She is lucky to have you here!

 

I am Canadian but had a destination wedding in Arizona in 2010 for my first marriage.  We had a justice of the peace marry us at a golf course and I believe we got the certificate right away.  We paid about $200-$300 for this service (her time).  I do know we had to go to a govt building to get a marriage licence a few days beforehand.  We both had to be there, show id and sign it.  So I am unsure how you would go about doing this if she is in the hospital, but Im sure there must be a way it can be obtained in this circumstance.  You might have to go there and ask questions in person to find out how.  I am not sure how well you speak English but perhaps bring one of her family members with you to help ask questions and get information.

I think this was a "worst case scenario".

 

I think all states require the physical presence of the bride and groom in order to apply for a marriage license.  Since that would not be physically possible, you may have to wait until she is out of the hospital to get married.  If that's the case, bc you marry outside the 90 days, you'd have to adjust as a spouse rather than a K1 who fulfilled the requirements.

 

It's worth a trip down to the hall in your town/city to talk to the clerk and see what they advise.  If you're in a small town, perhaps they can make alternative arrangements.  

 

Im really sorry to hear about your fiancée, that's definitely awful to happen at any time, but especially as you arrived here to start life together.

 

I'm not sure what kind of condition she's in, but any chance to get her out for a few hours to go get the license, if need be?

the i130 will be needed if you marry after the 90 days, it is an option, if you want to wait until your fiancé has recovered and then marry

 

if you marry after the 90 days are up you will need it

 

or as said you can bring the justice of the peace to the hospital and get married there

he will need to sign paperwork, call or go to the court in your city to arrange it if you decide to go that route

 

the justice of the peace can go anywhere, a friend of my family got married in a restaurant

I don't know what the laws are in your state, but I was able to get our marriage license without my fiancé being present.  However, I had to bring in a notarized form with his signature, and he also had to sign his part of the marriage license application and have it notarized.  You may be able to arrange for a notary public to go to the hospital so your fiancée can sign the marriage license (the hospital may even have a notary public you can use).  You could also try bringing in a doctor's note.

I agree with EandH.  I would wait it out at least for a little while, because as they stated, both parties have to be fully cognizant to enter into a marriage.

 

I certainly hope for a speedy recovery of your fiance.

I didn't know that!  

 

I'm in NY and we both had to appear in person for the license.  I also looked into a few other states when we were planning bc we kinda wanted to go away, but wound up just doing it at the state park in Niagara Falls.  

 

A notary is a good idea!!
