Will my taxes owed impact my wife's N400 application?

I am a US citizen, married for five years to my Australian wife who has her 10-year green card. We filed the N-400 application for naturalization nearly four months ago and are awaiting her interview to be scheduled, but I have a concern. I owe taxes to the IRS from year's prior to our being married (2009-2010) that I have not yet repaid, nor do I have a payment plan in place currently. That said, we've filed jointly every year since then and owe no taxes from those years. Therefore, she personally doesn't owe any back taxes. Could my back taxes from prior to our marriage effect my wife's N400 application?

No not in this case based on what you described. It affects the applicant if he/she owes taxes personally, unless he/she has a payment plan with the IRS and can submit such proof of making this payments satisfactorily.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

If she has applied based on her marriage to you , she may be asked questions about it - she will be under oath so that's something to consider - maybe have an explanation ready etc.

If she has applied based on 5 year residency, she may not receive any questions, but again she should have an answer.

 

Although she doesn't personally owe back taxes, she does legally share your outstanding debts as your wife -

 

Lecturing aside, taxes owed don't go away so you may want to reach out to the IRS and set up a plan where you pay $100 - $150 / month or so and just get it over with. With the new tax revamp in the works and with the new administration, things could get ugly very fast.

  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated
