Hello eveyrone ,

 

I am putting together the AOS packet and I am having trouble getting theings together.

We have a joint sponsor and he has filed his taxes married filing jointly. Because he filed jointly it will show their incomes added together. Does he need to include his wife's taxes as well? He is the only one signing the AOS for us. Also what forms does he need to include?

Yes, since they filed jointly you should present financials for both, and the wife should file a I-864A

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello, my name is XXXXX XXXXX U.S attorney, and I'll be happy to assist you today.

If your man sponsoring you pays taxes jointly with his wife, then I'd recommend that he fill out an I-864, and she fill out an I-864a. It will be easier to prove necessary income levels this way.

Because the wife has no income, if you don't want to fill out an I-864a for her, then you won't have to. However, your main sponsor is then under the burden of proving that the individual income he makes is sufficient to support you. He'll have to do this by finding old W-2s, paystubs, and other information that show his individual income, because he can no longer just show his joint return with his wife to prove income levels.

Here's the information from the field manual.

"If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsor’s own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099"."

Petitioner No Job ( still he has to file i 864)...Beneficiary from Nepal

Friend Joint Sponsor ( Husband has good  Income 70K & wife has no income, they filed Taxes Jointly ..

So, If Husband gives i 864 is good Info? & Wife not Required to give 864A ),This is Correct right.

Joint Sponsor 2016 year Tax Returns( 1 Year fine right),2 Pay Stubs and Current Employment Letter.
