My brother applied for adjustment of status through his wife born in the USA. My brother has worked legally here under a work permit and his wife is a stay at home mom. Since shes the petitioner, she could not be the sponsor for form I864 because she has no income. That's where I come in as a joint sponsor, and I filed another I864 as a joint sponsor for him. We received a letter asking for more evidence and I need help knowing what they ask from us. 

Part 1. 

You have submitted an English translation of a foreign birth certificate for the applicant; please submit a copy of the applicants foreign birth certificate issued by the appropriate civil authority.

- We submitted a copy of his Spanish birth certificate and a translated copy that was notarized, what exactly do they mean?

Part 2.

The joint sponsor's income on the Federal income tax return does not meet or exceed 125% of the poverty guideline. The joint sponsor lists their current income on Form I-864 as an amount to be considered as sufficient; . Submit evidence...include: letter of employment & pay stubs of the past 6 months. also submit assets.

- We included my latest tax returns for the 2016 year, and also in the poverty guidelines for Texas in my household of 4 the limit is $30.750. I make over $60,000 myself a year not including my wife's income. We filed married on our taxes, but did not add her in the I864. Shouldn't' my income be enough? What else do they need?

1) They may have overlooked his Spanish (original?) birth certificate, or you do not have the correct copy. Make sure the copy you use is the right one, and re-send it. According to the reciprocity schedule, you need to obtain it from the Central Registry in Managua? https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/NU.html

 

2) They ask you for a letter of employment stating your annual salary and six months paystubs. If you only send tax return (not tax transcript), also append your W2.

If it isn't difficult, it isn't worth it.

Things do get lost, we also got an RFE for a birth cert despite using a lawyer and being 200% sure it was sent. We just sent the original copy and translation again and it was fixed. It could have been lost/misplaced, could be you need a more clear copy, but either way its not a big deal.

 

A tax return isn't enough, you need to submit a tax TRANSCRIPT plus your w2 and pay stubs....if you can't get a job letter don't worry, some people can't and it is never a problem. Good luck.

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing
