Hi all, I am getting ready to adjust from K1 and still gathering necessary documents for AOS

I have these few questions and would like you all to tell me what to do. 

On the i-485 it asked if I have ever been arrested in or outside the US; the answer is yes. During my k1 in Greece, I submitted original official court decision. 

I have another original official court decision with me here but with a newer date while the translated copy has an old date (the same with the copy I submitted in athens) 

My question is, can I use the copies I have here? Example: original official copy 20 april 2017 / Translation  20 May 2017.

 

2. Please reconfirm if what I have for AOS is ok and remind me of something is missing or should be removed. 

- I-485 AOS App

- G-325A  Biographic info

- G-1145 E-Notification of App

- I-765 EAD

- 1-864 Affidavit of Support

- passport page

- visa page

- I-94

- Marriage certificate 

- Divorce paper for both of us and mine translated in English

-  I-129 approval notice NOA2

- Medical ( yet to contact a civil surgeon)

- Fees ( Not yet sure about the exact amount ) 

- Driver License 

- Car insurance (my wife added me) 

- Passport Photo ( Not sure about number of photos) Do I need 2 pcs for each for AOS and EAD 

- Tax papers w2 etc

- SSS

- Health insurance 

- Joint bank account 

 

Do I need to do the following:

- Add any Identification paper from my wife USC?

The total fee is $1,225 for the I-485, I-765 and I-131.

 

You don't need to submit a copy of your driver's license, Car or Healthcare Insurance, Affidavit from friends/family  and Joint Bank account. That's something USCIS wants to see when you do your Removal of Conditions in two years or IF you get an interview letter. I didn't submit any of those documents when I applied for AOS and haven't gotten an RFE/RFIE yet.

The divorce decree and identification paper of your wife is not needed here since you already submitted the documents when you applied for your K1 visa. USCIS already has all the documents.

What they want to see right now is a certified copy of your marriage certificate.

Your wife needs to provide the following: W2, recent pay stubs, a letter of employment, tax return from 2016 or 2015 to support her Affidavit of Support, I-864.

 

Submit 2 passport style pictures for each application (6 total).

What you also have to submit is the G-325A but only you need to do that.

I didn't submit a copy of the letter from the NVC and my husband didn't submit a new G-325A for him.

And only one G-1145 is necessary for the whole application.

Haven't gotten any RFE/RFIE so far.

Honestly,  It doesn't hurt sending in more.  I even submitted more than the site showed me.  I submitted joint credit cards evidence, bank account evidence and our lease.  I also submitted 2 G-325A, one for him and one for me.  I also submitted, W-2, TAX RETURNS, TAX TRANSCRIPTS, employment letters from both my supervisors.    Again,  I rather be safe than sorry.

Not everyone has all of the joint proof available when they file AOS or want to wait months with the application until they can provide the documents.

I will submit the documents to USCIS when they ask for it or when I do the Removal of Conditions.

No need to stress. Like I said, I did it so that I do not get an RFE or give them an excuse to question our relationship. Also, he arrived on mondday and the next day, Tuesday, we went to the court house to marry and also applied for his social security that same day. So getting that evidence was not time consuming, it's weather you are up to the task to get everything done as soon as fiancé visa holder arrives.  The sooner he got his social the sooner he was able to obtain a drivers license and a bank account. By the time the marriage certificate came through the mail, my husband and I had a joint credit card, a joint savings accounts and I updated my lease agreement since I had received the SSN. He arrived on January 30th And I send his AOS packed on February 14.

See...it might all depends on the state where you live in.

I live in Georgia and here the DMV wants to see at least the EAD before I can apply for a driver's license. The leasing office needs a copy of my driver's license before they can put my name on my husband's leasing contract.

His bank wants to have a copy of my driver's license and the driver's license number before they can add my name to his bank account.

The only thing we could do without me needing a valid driver's license was to open a joint savings account with Bank of America. They only wanted to see our SSN. But that's something we did after sending the AOS application to USCIS because we didn't want to waste too much time since I wanted to start working some time in June.

 

Your husband was lucky if he could apply for a driver's license without his EAD...I wish I wouldn't have to wait... 😕

Yea, different strokes for different states.  My husband was able to get his drivers license with his SSN and I-94. However, the DL had an expiration of 3 months. We then went back to the DMV with his NOA1 and they gave him a DL with 1 year expiration. Then we need to go back with the green card for a 2 year DL. 😤 That is the annoying part

You don't mention form I-131, application for Advance Parole.  I would recommend that you include that as well.  Without it, you won't be able to leave the country and return until you have your green card.  There is no additional fee if submitted with your I-485, but it does require 2 separate passport photos.

Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

Thank you LionessDion. I will add the court papers and possibly write a statement in addition. Dont you think it will delay my process and take so much time? I have copy of the court decision but the translations here are too expensive. Is better to translate here or take it to the country where I came from and translate?
