I've been married for 17 years with American Citizen, we lived in Dominican Republic most of the time, but we decided to come to USA for multiple reasons,including that we wanted to come back to his country.

I got my PRC on 12/20/2012 and  I am living in Texas since 07/04/2013.  I am thinking about getting divorced and going back to DR as soon as my daughter finish High School, she is planning to go to College over there too.  My question is : I read about the 3 year and 5 year options to become citizenship, I know I can apply for the 3 year option but I would like to get a divorce so I would like to do the 5 year option.  I was told too that I can apply 90 days before (09/20/17), I will try my best to wait until October here, but I would like to know how long after I start my citizenship do I have to stay here in USA? Can I leave after I send the paperwork ? if not, when can I leave?? . I was also thinking return my Green Card but I really don't want to do it, you never know if I will need it eventually in the future.

 

I need advice please, my marriage situation is unbearable and desperate to leave

I am not sure about weather or not you could file N-400 during a divorce process so someone else will answer that. However there's no downside to getting citizenship here if you want it and is eligible. 

 

So just get it while you can and obviously you have to be present the whole time in the United States. All the way until the oath. You could travel I'd believe but you have to wait until the oath so you can get an American passport.

If you are going for the 5 year option then the divorce shouldn't hinder the process. You have been married 17 years. Safe to say that there are no red flags. 

 

Unfortunately, one of the requirements for filing for citizenship is that you are stateside , meaning living in the US during the process. So after sending the paperwork you will not be able to go to the DR to live.
