What they want is a document to base the expiration date of the driver license on. Also depends on the state you're in. I live in Arizona and I came here through k1 visa. At the DMV, I was asked to bring my passport, the visa and the I-94 (which normally shows the expiration date of your k1 visa). I had to pass a written and road test to get my driver license. All went well and now I am driving around waiting for my EAD

Sorry to hijack with a long message, but we're having issues with the DMV today also. I made a separate post but if a mod wants to clean that up, please do. 

 

My husband got his AoS approved and we got his conditional green card in the mail since December 11, 2018. We went to go get his driver's license today and he took and passed the tests but they denied him the license because they said he wasn't in the system!? He already has his EAD, his passport is fine, he has his green card, social security number (they won't send is the dang physical card which maybe this is a part of?) And the woman told is Homeland Security says his status is not updated. I was so pissed because they told us that we need to go back to USCIS which for us is 3 hrs away and we have to rent a car and its a big hassle. I don't understand what us going to an infopass is going to accomplish because it seems like something internal on THEIR end needs to be fixed. Is there someone else we can contact? I tried looking into the SAVE thing, but I don't quite understand it. we called USCIS but weren't able to speak to a tier 2 officer.l but said we could make an infopass appt. They won't even tell us what we need to bring to the infopass. we have a giant folder of documents, but I'm just so confused. We are in Florida. 😡🤬 Thank you!

Hey! I'm a fellow Texan now, I'm think I've lucked out with my DMV experience here in Texas (I'm in Dallas), I first applied for a Learner's Licence as I've never driven before and literally all they have on the DMV website to take in - I did (They went off my I94 which already was expired when I was applying, but I did have my NOA1 from the EAD/AP and I-485 with me too). The only thing they had to do a Level 2 check on my lawful presence here, I first got a letter after a week saying they couldn't do it via DHS so they sent it off to USCIS, which after 3 days I got a letter saying Lawful Presence Verified. I got my Licence and took my written test and proceeded to take some lessons... 

However, last week I did go and try take my test and they said as we're removing conditions we need to re-verify your lawful presence so again I'm waiting on a letter to be able to take the test but I think I'll be good for my 6yr licence? So not sure if you'll able to go in and do that? If your licence isn't expired already? Might be worth trying another DMV in your area, like if you have a Mega Center? or a smaller DMV, because I've just gone to the small ones.

So if I understand you want to take your drive test to get a driving license and you also have a pending application for adjustment of status right? If you don't have your 10 years Green Card they might not give you a 6 years driving licence. If you only have you NOA-1 they might issue you an temporary DL for 1 year once they checked your legal status with the DHS. If you have your conditional GC your DL will expire within the 2 years validity of your GC.

About the DHS locations I don't know about Dallas, I'm 8 hours away in the south. Going to another location might not change a lot of things since you already started with your local one and they all have the same rules. If they give you a hard time go again to speak with someone else. But if they are going to send you a letter just wait for it ;)

Heh thanks! Was just a little disheartening on Friday, all psyched up to take the test and.... well we have to re-verify you ma'am and I'm like... NOOOOOOOOOOOO! and I see a Temp DL well better than being stuck at home right? 

Did you manage to get an extension on your DL?

I passed my test while my I-94 was still valid and I had to renew it using my NOA-1 once my I-94 expired. I had to go 2 times before getting an agent that accepted the NOA-1. But now I have a 1 year valid DL. I'll renew it with my EAD or GC depending which one arrives first! Seeing other VJ members that are stuck home without a DL makes me feel pretty lucky :)

Nice and yeh... I feel pretty lucky too being able to even try. Need something with this political climate too!

 

Hope the EAD and GC come quick for you!

Does anyone know the DMV laws for Illinois? I want to the DMV (in Downtown Chicago) today but didn't have my AOS I-797, so he told me to bring that but said it had to have "C6" or "C-06" somewhere on it in order to issue me a DL. My I--94 is expired and I am still waiting to get my EA and AP approved....

It's really stupid in NJ on K-1 and DL.
It's the 6point thing... We qualify, technically she is legally here, waiting for NOA1, we got over 6point, with other requirements fulfilled, but they DMV general line in Trenton said that they need an EAD or GC for issuance of DL, as a proof of permanent residency, and proof of her being legally here. 

I feel like if it will be the case, i'll contact my governor and explain that she can't work and thats understandable, but her not being able to drive, is like forcing her to be like a toddler again. She's here legally, there is almost no chances of her AoS denied (but there always is, USCIS...) as K-1 requires for AoS
When AoS took 6months , and EAD 3months, it made sense to wait for EAD and apply, as i-94 was valid for that time regardless. No processing times shifted, and beneficiaries are being left in limbo by state. I imagine if EAD would shift further into 8-12months period, would they keep the same policy for K-1 as well? That would be completely insane and useless to get a k-1.

K-1 (passport) + marriage cert + NOA1 for AoS should be sufficient enough to prove Your legal status in US, while Your EAD, GC are pending, as those were the requirements for K-1 visa.

Once i'll get her NOA1, we'll head to DMV and i'll update the outcome here.

When you say you had to go twice to get them to accept the NOA1, do you mean that the first time they wouldn't even try and put it into their system? Or that they wouldn't issue you a license and you tried again another time?

 

In my experience (Omaha, NE), they scanned the NOA1 for the I-485 and sent all my docs off for manual verification in Lincoln, NE. I got a letter today saying that the manual verification showed my status as "application pending" (that's no secret and is what I told them in the DMV office 🙄), and that I can go to a DMV office when my USCIS application is complete. i.e. I have to wait for the greencard before I can renew my license. Very frustrating since I was told by the DMV to wait until my i-94 expired before going to renew my license and now they won't renew it.

 

Just wondered if your experience was similar and you fought it and managed to get it accepted?

Basically they were checking my status on the SAVE system with the number on my I-94 and not with my alien number. They kept focusing on the my visa expiration, saying that the NOA-1 didn't have an expiration date, so eventually I chose to get at least my license even if it would be valid for a couple weeks. Then after further research I was sure that they were supposed to accept the NOA-1 as a proof to extend validity of my DL. When I went back the lady went to talk with her supervisor for 5mn and when she came back she told me they had to check my status, that it would take about a week and to come back when I'll get a letter from them. I did it and they processed my request and I got my 1 year DL 2 weeks later.

 

But unlike Texas is doesn't seem that Nebraska accept the NOA-1 as proof of residency, to issue a DL. Basically you'll have to wait for you GC or your EAD, depending which one arrives first.

Okay that makes sense. I'm not sure if they use my unexpired i94 or my alien number to verify me because they took both documents. So frustrating but theres not a lot I can do I suppose.

That's the same in California. You need the EAD (or GC) to receive the DL *card* (or ID card). However, in California you can still renew the DL without waiting for the immigration status validation. You just don't get the photo ID card but you can still drive with the paper DL issued at the DMV at the time of the application (no photo). Ask if that works in NE.
