I had interview on April 4th.  When I went to US Embassy in Islamabad, my name was not on the interview letter.  Upon entering the Embassy compound local Embassy staff calculated my CSPA and opened my application and asked us to pay the fees $325. 

 

After completing my application along with one older and one younger siblings, 4 of us were interviewed by CO.  At the conclusion of the interview, CO told us to go home and wait and he handed my mother a paper stating that you are under Administrative Processing.

It's imperative to always mention your country so people can help you better. So you are correct that your priority date is not current and your age is not locked. 

 

If by July 1st 2018 your priority date doesn't become current, you will age out even with CSPA. I'm so sorry to inform you that no lawyer or anyone else can do anything about it. 

 

I myself had my interview today, and was qualified with CSPA, the US Embassy had a CSPA worksheet, where my age was 19 and 11 months, and the status of the CSPA was: 'QUALIFIES' -- and both me and my family were approved.

Prior to getting current we called NVC several times to apply CSPA for me and my siblings, but they refused our request with generic statement.  "We will apply CSPA once your case gets current".  When my mother received IL, we called NVC again, this time they said go to the Embassy with your mother with the copies of all papers you have submitted to NVC, CO will apply CSPA on your case and that final decision will be made during interview.

Thanks for providing me details.I clearly understand this thing , i also know that i have time till July 1 st only .So thats why i am looking for certain cases if cspa age is missed by 1 or 2 moth do they approve visa or not , because its getting delayed by USCIC that's why  i am going to miss date. Let me know if you heard any case like this.Thanks again for helping me out ,

Congratulation bro you are eligible for CSPA.ur cspa age is 20 yr 9 month 10 days.So you don't need to worry about anything. You will get visa under CSPA law.

Your CSPA age is either under 21, or it isn’t. The latter case you age out even if by one day.

CSPA exists in the first place to help those affected by uscis delays, but unfortunately they can’t help everyone. (By the way it is not only uscis delays - it’s the effect of the legally prescribed numerical limits per category that is the principal reason for the delay from initial filing of petition, and the per country limits is why you as Indian are later than most others.)

Hi SusieQQQ so is there any other way ?Can we challenge this thing ? My mom dad has us visa & i m also in us on h1b , so if they come & do change of status from here only , can that thing do fast process ?

Your parents (a) can’t enter on a non immigrant visa with intent to adjust status and (b) it doesn’t change when your priority date is current anyway so has no impact on the CSPA calculation. 

 

On what basis do you propose to “challenge this thing”?

 

If you’re on H1B then look at getting your employer to sponsor you for a green card. Or wait for your parents to sponsor you under F2B once they get their green cards.

 

above all, remember that immigration is a privilege, not a right.

There is no "challenging" a CSPA determination when it is correct. It's not discretionary. You either qualify for its assistance or you do not.
