Applying for Re-Entry Permit While Awaiting New GC

Hi everyone,

 

I am about to apply to remove the conditions on my Green Card, but I am also about to take up a job abroad on a short-term 2yr contract, though my wife and I plan to return and live in the US after that.

 

I gather I need to apply for a re-entry permit. My question is: since it will take a while to get a new GC - is it possible to apply for a re-entry permit after I submitted form I-751, but before I have received the new GC, or will I have to wait?

Are you eligible for re entry permit of you are a conditional LPR

I think you're eligible to apply for a re-entry permit, although I don't know if they'll allow it if you have less time on your valid green card than the planned absence would be. You will get a letter that's good for another year tacked onto the end of your green card, but that's a maximum of 1yr +3 months, not 2 years.

 

Also, you will definitely need to be in the US for your biometrics appointment, which seems to be happening about a month after they receive your file. 

 

Then, you may be called for an interview, which you must attend. (This is probably about a year or so after your application.)

 

Apply for the re-entry permit, but have a backup plan in place if you don't get it, and have enough cash (or credit) on hand that you can afford to go back to the US on short notice for an interview or to get the I-551 stamp in your passport or what have you.
