Petty Theft on police record

Timeline

My fiance (beneficiary)  was 17 or 18 doesnt exactly recall what age he was but not older than 18 was caught with a group of friends shoplifting at a super market a bottle of alcohol. He was arrested and was jailed for 5 days. He is now 30 turning 31 next month in June and has not been in trouble ever since. He went to get his police record today and it says petty theft but doesnt give any details. He plans on going to court this week and getting a more detailed report that shows what happened etc. Do you guys think our Visa can be denied because of this??

Is your fiance the US citizen or the foreigner?

I'm not a lawyer, but that could be an issue. If you have any criminal record it can make you inadmissible to the USA. Your timeline shows you have your NOA2, you should have disclosed it already.

I'm definitely not a lawyer, but you definitely need to get in touch with one. Because it will probably come up.

I agree that you should see a lawyer. USCIS sometimes forgives the criminal record of a US citizen's spouse, especially if the spouse has a history of good moral character (your spouse has not gotten into trouble since he was a teenager) and if the crime was relatively minor. Of course, I'm not a lawyer. Good luck!

Any progress with your case, I am having the same issue with my mother, she was charged with petty theft  while in the usa like 15 years ago, i am afraid embasy will deny due to her 1 offence.

Well we are still gathering some court documents.  But the embassy called me and I spoke to a lady, not sure who it was because she told me she couldn't give me her name. I expressed my concerns to her that we would be denied due to his arrests. She told me people with worse crimes have gotten visas. That gave me hope. We are almost done and hope we do get the visa at the end.

Hi any updates I am still waiting for a case number this wait is torturing me..... I hope your case is going right and you were able to gather your documents, looking at your timeline did you already went to an interview ? last year?

And she is right , some people overstayed their visa for more then 6 month , had some criminal record and still got their K1 visa

Where are you in the process??  We are still waiting for 1 more court document!. And yes my fiance did his interview last year!! We have not been able to move fwd with our case! Too many things!

We are still waiting for case number not even close yet. But we have a misdemeanor charge and we want to have an idea what they will ask so we can be prepared. We have court record with final disposition but would consular officer ask for more ?
