extend the 6 month stay

Hi,

 

My mother is visiting me in the US on a B1/B2 visa, and recently she had some chest pain and I took her to a doctor.  we were told that she has Atrial fabulation.  I am really concerned about her flight back home, and want her to stay longer with me to make sure she is stabilized.  Is there a way that I can apply to extend her 6 months stay?  what paper work I may need for this application?  I have heard even if she is able to get the extension approved, she will have hard time come back to US once she go back home.  is this correct?

Yup, she needs to file an I-539 (https://www.uscis.gov/i-539). She maintains authorized stay while it is processing.

A visitor should spend at least as much time outside the US as in it, but personally I go by the rule of spending twice as long outside of the US as in it. There may be non-immigration implications (taxes in the US, government program eligibility for their home country, etc.) for staying over 182 days of a year within the US / outside of their home country.

Is she being treated for atrial fibrillation?  Before she does fly home, once that's settled, check with her airline. Some of them have a requirement to get medical fitness to fly, if recently unwell.

The first people to speak to are would be her Travel Insurer, they usually would wish to repatriate asap.
