I didn't include form I-765 for my child.

Help PLEASE,

I didn't include form I-765 for my child, we filed AOS together, our application was delivered on May 3rd at the chicago office.

I actually got bits of direction as per the filing from a friend (who happens to have 2 kids) and they all applied for AOS few months ago, she said i didn't need to file for form i-765 for my child as she didn't too, that as long as she gets her EAD, automatically the children will be given EAD too. 

 

And I'm aware you need EAD to get SSN, so if my child doesn't get EAD that means no SSN.

 

So another friend that sort the help of a lawyer told me this isn't true that even though the child can't seek for employment they still need EAD to get SSN, and that I can still send the form I-765 as soon as i get NOA for our application and I also do not have to pay any fee again. I also read online on the instructions for form I-765 which says;

 

NOTE: If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765. You may file the Form I-765 with your Form I-485, or you may submit the Form I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007. 

 

So does this mean I can still send in the form, and don't have to pay any fee, anyone had this experience before?

please your advice and input will be greatly appreciated.

AOS Timeline:

05/01/2017: Forms I-130, I-485, I-765 sent to Chicago, IL (didn't include child's form I-765)

05/03/2017: Delivered.

05/10/2017: NOA1s received via text/email at 11:30pm.

05/15/2017: 5 NOA1s received via mail 

05/16/2017: Form I-765 (for child) sent to Chicago, IL.

05/20/2017: Biometrics appointment letter received.

05/22/2017: 1 NOA for form I-765 (for child)received by text/e-mail.

05/26/2017: 1 NOA received via mail.

06/02/2017: Biometrics done.

06/04/2017: Biom appt letter rec'd for child's form I-765

06/14/2017: Biometrics done.(for child)

06/14/2017: Both Forms I-485; Ready to be Scheduled for Interview.

08/18/2017: EAD, new card being produced.(day 108)

08/23/2017: EAD, card is being mailed (day 114)

08/26/2017: EAD card received (day happy)
