My brother in law went through the same process. My wife's sister is also american and they have started the process before us and now they are in USA.

 

Since we have two kids and she can not obtain a visa for them it doesnt' make sense for her to move to USA then for us to follow her.

Can you please why it would delay the case? We have sent an Email to NVC and they told us to submit the request online which we did. When we checked with the embassy in Riyadh they said that we need to submit the expedite request to NVC and not to them.

 

We will be OK if the interview is scheduled in the first two weeks of July, our original plan was to travel in the second half of July.

Can you please explain to me what does this mean? My wife is an american citizen and we're both living in Saudi Arabia. She left USA when she was 4 years old.

"domicile" in the USA means evidence of at least 5 years living there after the age of 14.  Your wife does't meet these requirements, so your "friend" you mentioned will need to be the sponsor and the one proving enough income etc.

That's not what "domicile" means. There is no 5 year restriction for domicile. I think you're confusing domicile with the requirements for citizenship of a child born to a US citizen + foreign national (that's where there is the 5 year physical presence rule comes into play, including at least 2 years from age 14 onward).

 

The issue is she has her primary residence outside the US, so she needs to either:

  1. Show evidence of having US domicile (bank accounts, taxes, property, etc.).
  2. Move to the US and establish domicile there prior to the OP.
  3. Show sufficient evidence of intent to (re)establish US domicile.

 

What they are trying to avoid is having the immigrant come to the US while the USC/LPR remains living abroad. That defeats the family unification purpose of the visa.

They don't expedite unless for severe hardships which may be incurred due to the interview. Whiles it's under review for expedite, you never know what can happen if it's not approved.

 

before requesting, you should ensure you expedite request meets the criterion. Then take the appropriate course of action :https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume1-PartA-Chapter12.html

Clearly that's not happening with our case, we have two kids who are in school and we're all leaving at the same time. We have already tried to establish few things but being remotely doesn't help much so we have friends and family helping us.

Yes as someone else mentioned this is not correct. If she stayed in USA for 5 years after the age of 14 we wouldn't have to go through this lengthy process. She could've given our kids the citizenship immediately.

 

But since she didn't live in USA after the age of 14 we have to go though the petition process.

Our interview was yesterday (we asked them to do it earlier in order to expedite).

 

Things went very well and we were approved. They only asked for original documents of

 

birth certificates

marriage certificates

medical exams

police clearance.

 

That's it, asked ony 3 or 4 questions.

Hey,

Please don't be nervous at all. We arrived to the embassy at 12:00 but the appointment is at 12:30 and they don't let any one in until 12:30 so you have to wait outside and it's hot but they do have a fan.

 

So my advice is not to arrive more than 15 minutes before your appointment.

 

We were given a number and then we waited for a few minutes and our name was called to window 12, a nice guy talked to us and asked us for the original documents such as birth certificate and police clearance.

 

Then he asked a couple of quesstions and told us to set and that our name will be called.

 

it was called and we met with another guy where we did the finger prints and he asked maybe 2 or 3 questions,he didn't ask to see any photos or anything and he didn't ask about domicile.

 

It was clear I guess that we're a family cause we have two daughters. 

 

Overall the staff are very nice, polite but be ready to spend 2 hours maybe more. We came at 12 and left at 3:15 PM.

 

As long as you have all your papers things will be smooth.

 

Update: Today my visa was issued :D after 9 days. if you have any question please dont' hesitate to ask me, btw they do speak english and arabic but i feel easier speaking English

Congrats!! Did you guys register for the interview or just went to the embassy on the date /time mentioned in the PR letter? Did you guys pay for the GC at the embassy if so how much? Thnx

Thanks a lot.

 

There is no need for any registration (we were confused about it and asked the embassy before and they said no need). We just went to the embassy, stand in line then they gave us numbers inside.

 

We didn't pay for the GC at the embassy.
