Me and my fiancé understands that K1 visa processing would take about 7 months and that is such a long wait for us.

I read it here that it is possible for me (from Philippines) to visit US thru a tourist visa while K1 is still in process.

I applied for a tourist visa last January and I got denied, might be because my fiance's divorce is not final yet that time or might be because of my status, since the consul handed me that blue sheet with the details of section 214.

And now we are thinking about filing B2 visa again, while we are processing the K1.

What are the chances of having my tourist visa approved this time? Any same case as me here?

Would appreciate replies.

Your chances are very slim; you are a young, single female from a poorer country, you have already been denied once, not even 6 months ago, and you have clear immigrant intent as you have a US fiance and field for a K1 visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

hi there. sorry to be a downer but your chances do not look good.

 

first, yes, you can definitely visit the US as a tourist even with a K1 visa in process. BUT, this is only to visit, you are not allowed to stay beyond the time given to you at the border. entering the US on a tourist visa with the intention to overstay because "you have a K1 petition pending anyway" is visa fraud. do not even go there.

 

second, entering the US on a tourist visa with a K1 petition in the system will be tricky. search here on VJ and you will find lots of stories of people getting turned away at the border and not allowed in, even with a valid tourist visa in hand.

 

finally, tourist visa applications are reviewed based on an applicant's own merit. there is no such thing as sponsorship for a tourist visa. the denial of your B1/B2 visa application in january has nothing to do with your fiance's divorce not being final. in order to be granted a tourist visa, you need to convince the consul of strong ties to your country of origin, strong enough so that they are convinced that you will exit the US after your trip is done. you having a USC fiance means you have much stronger ties to the US than home and therefore raises a big red flag of a potential overstay. applying again so soon, with no material changes to your circumstance and while a K1 petition is pending, will most likely result in another denial.
