Helppp! So, I got married MARCH 2015 but then when I filed my taxes for 2015 I put Single because I was recently married then. And I haven't change my status on SSN as married that time. Now, I have to submit taxes form to NVC to petition my husband. I claimed married filing separately the following year. What do i do? Will there any red flags?

also if u got married march 2015 and did ur taxes april 2015, then u would put single because they only see u as married if u got married dec 31 2014 or earlier.

so for 2017 taxes, i would only put married if i was married on dec 31 2016. if i got married jan 1st 2017 then i was single all of last year.

2017 is most recent if u have filed them. im only submitting my 2017 taxes that has married filing separately status and lists my spouses name. u dont have to submit past three years. u can only submit the latest year which is 2017 or 2016. if 2016 has issue then u can either amend it and change status which is obviously better or take the risk where they might catch u listed as single even though ur married and that can cause issue or red flags. if 2015 has issue then u dont have to submit it. just my opinion.

Thank you! Im thinking of that one too (not submitting my 2015 tax forms). I dont make enough so I have a  joint sponsor. For 2016, I filed Married but filling separately. Im gonna do the same this year. But my 2015 tax form says single. I should just not submit that, right? Would that be ok?

I got married march 2015 and did my tax for 2015 on feb 2016. If that makes sense. Technically, I shouldn't have do that. But someone told I could. I shouldnt have listened.

it says this online "If you completed Form I-864, I-864A, or I-864EZ submit an IRS tax transcriptfrom the most recent tax year."

most recent is 2017 if u filed them or 2016 if u did not. do which ever makes u look the best financially, has the most accurate status etc and no errors. i have better income this year, have my spouses name on 2017 return so i  will use my 2017 return because it presents me in the best light financially and i know there are no errors in the return and it has my spouse name which helps build a strong case and theres no fraud.

ok it doesnt matter when u do the taxes. so 2015 taxes cover the dates jan 1st 2014 - dec 31 2014. for married status they would ask, were u married on dec 31 2014. if u say no, which u would, then ur status is single. simple.

so my 2017 taxes asked me was i married dec 31 2016 to which i replied yes since i got married march 2016 so i filed as married.

from i864 instructions

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Thank you! You've been really helpful. So, Im fine then. I don't need to send my 2015 tax form since I don't need to establish sufficient income anyway since I will be needing a joint sponsor as I only worked 3 months in 2017.

Thank you for help.

The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case)  -this is from the guidelines here in Visajourney

Hello everyone, My husband (who is green card holder) filled i-130 for me received noa1 on May 24, 2017 from California Service Center but we haven't approved (not received noa 2) yet. I am from Nepal, he want to visit me for 2/3 weeks, does it affect on our processing? Due to his visit may our processing be delayed?

My mom's case is finally approved,  after mistakes from uscis and several phone calls. I received the approval letter today, dated for 02/03/2018.

Pd. 05/31/2017.

Texas

Btw, on 12/22/2017, uscis "sent a rfe letter", that I never received. Cuz it was a glitch in their system or so. After waiting a month to ask them about it, they reviewed and told me that it was a mistake and to keep waiting... no status changed in the website
