My PD is May 30th as well with TSC. I’m happy for June approvals but I also really want them to work on ours as well. I hate how mysterious this whole process is. I’ve no idea how there are still pending cases in May while June is being approved if they work on cases in chronological order like they say they do. I check my mail every day as soon as I get home. I refresh the app like a 100 Times a day. I miss my husband so much. It’s so depressing and frustrating :(

Congratulations on your approval but this is a May 2017 thread

My apologies. I thought some people might want to know what dates they are approving.

My PD is May 30, Texas Service Center. I see that some June application are approved. Mine says 195 days, why they are not working on may cases and are approving june cases. 😔

Hi Anna and Mahias.

It's okay, My PD date is April 28th, TSC, (see my signature for more details)

My case was over 226 days. I called Tier 2, they said they JUST started looking at my case on Nov 30th. It should take a week to 10 days for approval after Nov 30th for me.

You guys should expect something by end of December. Just don't worry, don't read these boards too often. LOL, it may stress you out too much knowing May people are basically done... (I'm April!) lol

With a pending I-130, you have zero chance to be approved for a tourist visa . B1/B2 cant be guaranteed to anyone if they have the intention to immigrate to the US. You have declared your intention to immigrate when the I-130 was filed on your behalf. You will be denied with no doubt as you will be asked why you need to go. Unless it is a true emergency situation. That is a piece of the law regarding immigration intent (see number 2 and 3)

What does a visa denial under INA section 214(b) mean?

This law applies only to nonimmigrant visa categories. If you are refused a visa under section 214(b), it means that you:

  • Did not sufficiently demonstrate to the consular officer that you qualify for the nonimmigrant visa category you applied for; and/or
  • Did not overcome the presumption of immigrant intent, required by law, by sufficiently demonstrating that you have strong ties to your home country that will compel you to leave the United States at the end of your temporary stay. (H-1B and L visa applicants, along with their spouse and any minor children, are excluded from this requirement.)
  • (b) Every alien (other than a nonimmigrant described in subparagraph (L) or (V) of section 101(a)(15), and other than a nonimmigrant described in any provision of section 101(a)(15)(H)(i) except subclause (b1) of such section) shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for a visa, and the immigration officers, at the time of application for admission, that he is entitled to a nonimmigrant status under section 101(a)(15). An alien who is an officer or employee of any foreign government or of any international organization entitled to enjoy privileges, exemptions, and immunities under the International Organizations Immunities Act, or an alien who is the attendant, servant, employee, or member of the immediate family of any such alien shall not be entitled to apply for or receive an immigrant visa, or to enter the United States as an immigrant unless he executes a written waiver in the same form and substance as is prescribed by section 247(b).

It is kinda weird that most likely you will get an immigrant visa but then they deny u entry based on the intent you already legally declared. But it is the law.

Also, if you decided to do it anyway, it will NOT hurt your immigration process...totally two different things and not related in your situation.

Wish you get approved soon.

Thank you 😔 😔

Waiting game gonna kill me

Hello everyone,

This is my first time posting on this thread, although I have been following and reading through the posts for the past couple of months.

My PD is May 18 and I was getting worried after I heard nothing from USCIS and the time that VJ estimated for my approval had also passed. So I contacted my congressman's office on December 1st.

Lo and behold I got an email from the staffer today that my petition was approved on Dec 8th! On to NVC now.

Thank you to all who have posted who have gotten me through these many long months of waiting.  For those who are still waiting, best of luck! I'm sure you'll hear from them soon.

Posting this everywhere.  Just an FYI for May Nebraska filers.  Nebraska is working at Mid-Late march but we have confirmed 2 cases where early April have gotten RFE's in the past week.  Looks like we might see some movement on early/mid april before the holidays.
