Congratulations!! That is great news. I called twice this week to try to speak with a tier 2 again.(I've  called twice for a TIer 2 since September) The first time the recording said the wait time was 6 mins. I never received a call back. The next day I called again and the wait was 62 mins. I never got a call back. I was able to do a case inquiry again on the USCIS website. I already did one case inquiry on Nov 6 with a response that our case was in line to be reviewed. Our PD date is April 19 at Potomac. So frustrating to not know why our case was skipped. Most April  cases  were  approved back in September.  I'm going to try again first thing Monday morning.

After 10 day later i got rfe they asked me about proof of our both birth certificate cos... We both make our ceritficate mine 2008 and her 2006 before we did nt have in india . They want regarding evidence of cerificate . These are

relgious certificate

early school certificat

census record 

if i dnt ve all these thn they said u make affidavit of two person who are on that event on birth . This is one easy i can make but i dnt knw why they send it our certificate are original .i just wanna tell to them who are have same thing make late bith cerificate thn make affidavits or proof thnks before they ask

If a visa is required to travel

to USA to see your husband, then you will have to go to the us embassy in your country visit the website, I believe you need to apply for a dc-260 set up interview and try and get approved for a tourist visa. This will not affect your processing.

A beneficiary with a pending I-130 already declared his/her intention to immigrate to the US. Almost all B1/B2  visas to visit someone in the US will be denied if you have a pending I-130. Even those who happened to have a valid B1/B2 visa before submitting their I-130 can and most likely will be denied entry if it is known they have a pending I-130 if asked at the POE.

There is no way to visit the US unless, maybe, in a true emergency situation.

With a pending I-130, you have zero chance to be approved for a tourist visa . B1/B2 cant be guaranteed to anyone if they have the intention to immigrate to the US. You have declared your intention to immigrate when the I-130 was filed on your behalf. You will be denied with no doubt as you will be asked why you need to go. Unless it is a true emergency situation. That is a piece of the law regarding immigration intent (see number 2 and 3)

What does a visa denial under INA section 214(b) mean?

This law applies only to nonimmigrant visa categories. If you are refused a visa under section 214(b), it means that you:

  • Did not sufficiently demonstrate to the consular officer that you qualify for the nonimmigrant visa category you applied for; and/or
  • Did not overcome the presumption of immigrant intent, required by law, by sufficiently demonstrating that you have strong ties to your home country that will compel you to leave the United States at the end of your temporary stay. (H-1B and L visa applicants, along with their spouse and any minor children, are excluded from this requirement.) 
  • (b) Every alien (other than a nonimmigrant described in subparagraph (L) or (V) of section 101(a)(15), and other than a nonimmigrant described in any provision of section 101(a)(15)(H)(i) except subclause (b1) of such section) shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for a visa, and the immigration officers, at the time of application for admission, that he is entitled to a nonimmigrant status under section 101(a)(15). An alien who is an officer or employee of any foreign government or of any international organization entitled to enjoy privileges, exemptions, and immunities under the International Organizations Immunities Act, or an alien who is the attendant, servant, employee, or member of the immediate family of any such alien shall not be entitled to apply for or receive an immigrant visa, or to enter the United States as an immigrant unless he executes a written waiver in the same form and substance as is prescribed by section 247(b).

It is kinda weird that most likely you will get an immigrant visa but then they deny u entry based on the intent you already legally declared. But it is the law.

Also, if you decided to do it anyway, it will NOT hurt your immigration process...totally two different things and not related in your situation.
