My husband and I filed an adjustment of status application for me, the alien spouse, in September 2016. We did not hire a lawyer. Our initial interview for the I-485 is in early June.

 

Our cover letter correctly states that this is an AOS petition for an alien spouse. My husband's I-130 was also correctly filed. However, I made a mistake in form I-485. I ticked the wrong box in response to the question "I am applying for an adjustment to permanent resident status because:" (Part 2 - Application Type). Instead of box (b), I checked box (a). Screenshot included below.

 

Should I contact USCIS to correct this mistake? How might I go about it? Should we clarify during the interview? It is possible that USCIS realizes that we made a silly mistake, given that the I-130 was correctly filed. We did not get any requests for evidence and my I-765 and I-131 were approved. It would be terrible if our application is delayed or denied because of such a silly error.

I would personally call them and get their opinion. The likelihood is that you will just need to correct them at the interview

Thanks - I'll call the National Service Center tomorrow. From what I've read online, the immigration officer will review your application with you during the interview. This provides the applicant an opportunity to correct any mistakes. Of course, I'll sleep better if the mistake can be amended beforehand. :)

 

If others have experiences similar to mine, I'd love to hear.

That's correct from what I understand. They'll ask you questions about the forms and probably just ask why you filled it out incorrectly and you'll tell them

and it'll be fixed. The only reason your case would be denied is because of the payment or something huge. Not one box on the form

It actually looks like I selected the correct box (a) based on the discussion the Visa Journey forum, included below. My husband is a US Citizen and not someone who also applied for AOS or has an immigrant visa. The form's wording is pretty confusing. Yay!

Thanks. I was looking at the first part of the sentence in (b), "My spouse or parent applied for adjustment of status" and assumed that this meant that my spouse or parent had applied on my behalf. :) I was a bit baffled by (a) "an immediately available immigrant visa number that has been approved" since I'm trying to adjust from F1. Do I have an "immigrant visa number"? Is this my receipt number and/or just a way of saying that my priority date is the date that USCIS received my application?

I would assume that's either your receipt number or maybe alien number?
