HI,  I AM MAKING A PETITION FOR MY MOTHER UNDER IR5, I HAVE A BROTHER THAT IS UNDER AGE OF 21. IS THERE ANY WAY THAT I CAN INCLUDE HIM IN THE PETITION THAT I AM MAKING FOR MY MOTHER? OR DO WE HAVE TO WAIT UNTIL SHE COMES TO USA TO MAKE A PETITION FOR HIM?:rolleyes:

29 December 2015 - married in Dominican Republic

 

USCIS Phase

21 November 2016 - I-130 sent to USCIS Chicago Lockbox 

22 November 2016 I-130 received at Nebraska Service Center

25 November - NOA1 received in the mail

???? - NOA 2 via e-mail, app and USCIS website

????- NOA 2 received in the mail 

????- Case Was Sent to Department of State

IR-based petitions do not have derivatives. Technically you could petition for him under F4, but that would be a 15+ year wait. It would be better for you mother to petition for him once she comes to the US. He would fall under F2A if he is still a minor at the time, which is about a 2 year wait. If he is over 21 at the time of the petition is accepted, then he will fall into F2B, which is about a 7-8 year wait. If he gets married, he won't be eligible for any visa (unless your mom becomes a USC first).

very critical point in geowrian post.

if he marries before his mother is a citizen then that petition dies right there and can not be brought back. if he marries after his mom becomes a citizen there are no issues. these are only for his mother's petition for him any petition you make för him is not altered by marriage but also takes a lot longer.

 

that being said don't have him hold up life just for the sake of a visa.
