Submitting I-131 after I-485, what is required?

Hi all,

 

I entered the USA on a L-1A visa, and I'm now married to a USA citizen. I have already submitted my I-485 and I-765, and my biometrics appointment is today. I'm going to need to travel in September for family reasons, so I need to file a I-131.

 

What do I need to attach/send with the I-131 form? So far, I have the following:

  • Scan of my passport identification page
  • Copy of I-797C receipt for the I-485
  • Two passport photos with my A# written on the back

 

Also, will I have to have another biometrics appointment for the I-131?

2017-04-07: Case received at USCIS (submitted forms I-485, I-765, I-130)
2017-04-17: I-797C Receipt received (for I-485, I-765)
2017-04-22: I797C Receipt received (biometrics scheduled for 2017-05-08)
2017-05-08: Biometrics appointment completed
2017-05-11: Travel form I-131 received at USCIS
2017-05-15: I-797C Receipt received (for I-131)
2017-07-25: Service Request made online for I-765. ETA to hear back: 2017-08-06
2017-07-28: "New Card is Being Produced" (not because of SR)
2017-08-01: EAD is being mailed to me, according to MyUSCIS
2017-08-03: Received EAD
2017-08-11: Received I-512L (Advance Parole)
2017-10-16: Address change submitted online
2017-11-02: Address change completed by USCIS

2017-11-24: I-797C notice date for interview
2018-01-03: Interview took place

2018-01-05: Green card approved (I-485)

Sounds like you're set! Just make sure to put the date on the passport photos, too. I don't believe you'll get a biometrics appointment, as I filed for all three simultaneously, and the letter only stated it was for the I-485 and I-765, but I did receive an EAD/AP combo card. You might, you might not, but I'm pretty sure it's not.

I also submitted my I-131 after the I-485.  This is what I included with the application without any issues:

 

Form G-1145 e-Notification of Application

Form I-797C Notice of Action (from I-485 application)

Scan of my passport ID page and FL drivers license on the same page

I am about to send off for my I-131, I have already had my biometrics for I-485/EAD (a month ago).

 

Just checking, when I send my I-797C, should it be the one with the Biometrics appointment on it? I didn't receive a separate one. I also received a request for initial evidence for my I-485. Obviously I have satisfied that as my case is ready to be scheduled for interview. Should I include that RFE letter as well?

 

Other than that it sounds like, Passport page (also the K1 page?) and 2 photos. Some people have mentioned I-94, some haven't. My I-94 has expired. Should I send it as well?

I94 is used to prove that you last entered the US legally, I would include it. Also include your K1 and copy of the entry stamp.

 

It should be the very first i797c for your i485 case, the notice of acceptance. It would've arrived before the biometrics letter.

 

RFE information is not relevant.

If it isn't difficult, it isn't worth it.

Thanks. I found my initial I-797C for both the I-485 and I-765. I included those along with my I-94, my passport ID page and K1 stamped page, as well as my biometrics appointment, stamped, to show when I had that. 2 passport size pics as well. So hopefully that will be that!

Thank you all for this current post.  I think i'm 99.9% sure but wanted to check again about an additional biometrics/fee with the I-131 filed after the I-485.

 

It is my assessment that the biometrics and fee is NOT required if you have a pending I-485 application.  Is this what you went with as well?

Start a new thread nextime instead of hijacking one from 2017.

 

Send it to the address in the instructions.   Make sure you are using the current forms.  There is no additional charge for filing the AP and EAD at the same time.   Refer to to guides here.   You need an I-864 as well.  IF you are in doubt of the fees then use the USCIS fee calculator.

Thanks for the answer but I think it's my choice which thread I would like to choose.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
