Hi,

 

I am an American currently living abroad with my Ukrainian girlfriend of 3 years. I plan on filing I-129F once I return to America (or possibly before), but had a couple questions first... 

 

1) I've been living abroad for the past 2 years and have failed to file tax returns the past 3 years. Even in America, I believe I was making under the 125% requirement. Should I file back-taxes as soon as possible, or is it unnecessary if I use a co-sponsor?

 

2) If it is necessary, how exactly should I go about getting my W2's from previous employers and filing taxes from abroad?

 

3) Since the need for Affadavit of Support won't come until later... would it be better to wait until I return to America to sort taxes out?

 

4) Is it possible to file the 1st I-129f from abroad by mailing it to USCIS office or sending petition package to family who can do it on my behalf?

 

 

If I can get a head-start on the process while still living overseas, then that would be perfect.

If you get married you may be able to do direct consular filing. Otherwise you have to be in the USA I believe. I suppose you could send it to a USA address, but it would be easier if you were in the USA. 

 

You definitely need to file your taxes, even with a cosponsor you need to send in forms. If she eventually does her AOS you need them as well.

You need to file your taxes, the sooner the better for your own sake (although not required to show proof until later in the process).

 

You can send the package from abroad or via your parents in the US. Two things to keep in mind: 1) USCIS only accepts checks from US banks. 2) Use a US mailing address, as the USCIS will not send notification letters to foreign addresses.

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

I should also add that my girlfriend and I have been working for foreign companies under-the-table for the last two years, in two different countries (not in U.S.) Will I need to explain where my savings are from? Will she need explain where her savings have come from?

 

When I file taxes, it will only show income from my last job in America nearly 3 years ago.

 

I plan on using a co-sponsor anyway, but the USCIS will take a look at both me and my fiancee's income, so I need to know how to prepare.
