She can apply for a visitors visa, but will most likely get denied.  She is already considered a beneficiary on a K1 Visa, so that shows intent to immigrate.  Remember, the main thing about this K1 process is PATIENCE, PATIENCE, PATIENCE!  YOU HAVE TO BE PATIENT.  My fiancee has her interview on May 24th.  I applied on October 14th.  I would probably have this process done by now if it wasn't for a lost RFE.  You have to remember this is a long, government process.  It takes time.  You just have to sit tight and wait like the rest of us.

Super agree!!!

Your NOA2 did, but you definitely waited longer for the rest considering you had the sputum test.

Yup, sorry that's what I meant. Our petition got approve in 4 months from sending petition and another 5 months for k1 visa process because I had to go through sputum test. But I had a friend she's now in Michigan, only took them 3 months from filing the petition to approval of visa.

Each case is different. IMO the longest wait for us us gonna be from NOA1 to NOA2. Everything after that starts to move a little faster based off of my review of multiple timelines.

It's ideal to want our fiance here with us ASAP which is why my fiance and I made sure we both understood that this process isnt an overnight deal before I submit mine next week. Like I told him, use this time to SAVE, SAVE, SAVE as much money as possible because the first 3-4 months here you won't be able to work and I'm also saving.

Also, take the time to start getting personal affairs in order and enjoy her home country as long as she's still there. Because just like it'll be 3-4 months before she can work, same thing with waiting on the AP to fly back home with the chance to come back to the U.S.

You just came back May 1st, that's great!! Next month, you guys should be entering the next phase. You have the rest of your lives to spend together. The next 3 possibly 4 months will be here and over real soon!

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

You don't need to be afraid of an RFE.  It happens.  In my case, it was something super simple...I forgot to check ONE box on page 5 of the I-129F application.  JUST ONE BOX.  It was an easy fix, except for the fact that it got lost.  Now, that being said...I did NOT make a copy of my original RFE sheet.  It is blue and has a bar code on it.  The reason I share this with you is to educate you and not scare you...MAKE COPIES OF EVERYTHING YOU SEND AND MAKE SURE TO GO TO THE POST OFFICE DESK AND ASK FOR A DELIVERY CONFIRMATION ON EVERYTHING YOU SEND.  I did not and it almost ended up costing me another application fee.  I used my congresswoman to intervene, so save yourself a lot of worry and lost time and make copies of everything you send.  A tracking number is an ABSOLUTE must to protect yourself in regards to time frames. USCIS is very strict on timeframes and the last thing you want to do is have to start this expensive, tedious, long process all over again.

I wasn't going to pay someone else to do what I am capable of doing.  I made a mistake, like so many others do....it's a learning process and I'd rather do it myself because if there is a delay or error, it is my doing.  If I pay someone hundreds or thousands of dollars to do something and them mess up, causing me a two months delay, that would NOT be acceptable.  I am a much stronger individual for having done this process myself.

It's definitely a complicated process. Without this site I never would have done it alone. I just Googled any questions or asked on here and checked everything 5 times. It's worked so far!!!

I've heard lots of stories about people paying people and still waiting a really long time because somehow they messed up. No one can guarantee anything, so I didn't see the point in a crazy over priced lawyer.

You're the United States citizen right? It depends on the crime. Any domestic abuse or violence could be bad. However, a misdemeanor theft charge or something like that wouldn't make a difference.

That's not very long so far. I'd suggest calming down and getting patience, because you have a long way to go.

We've all been through it, just talk every day and support each other!

Also, I'd suggest creating a timeline it helps other members and it helps when you ask questions, so we know when exactly you filed and everything.

Yes I'll make one soon as I have off.

So, it's a domestic violence charge? Depending on the outcome of it you might have an issue or some explaining to do at the very least. Now I am not a lawyer, so I can't give specific details. However, you may want to at least contact an immigration lawyer and see what they say.

When the fiance does her interview they actually give a pamphlet about domestic abuse, so obviously they're very concerned with it.

Again, I'm not a lawyer and the outcome of your case would make a difference as well as the circumstances and how recent it was.

What do you mean it's not a crime until you violate? If you got arrested it will show up. You did the right thing being honest.

Good luck!
