About to start K1 visa process for fiancee from travel ban list

Hi all, 

I was wondering if Trump's travel/immigration ban would still affect the K1 process for my fiancé from Syria? He is currently living and residing in Turkey and the instability is making me nervous to begin.

Last I heard, the second version was being challenged in court and was only suspended until further appeals. Not necessarily gone.

It currently has no impact on the process. If the stay were to be removed, then the 90 day ban would resume (barring more successful challenges). Either way, if you want to be together in the US then the sooner you start the process, the sooner you can be together.

 

There's no hard timeline for the ban to be ruled on, but it's likely too far out for anybody to make a good guess when a final ruling will be made. Your case may be adjudicated before that even happens.

Hello,

I did not want to start a new thread because my question is similar to this line. 

I submitted an I129F application on October 13, 2017. It was received on the 16th, and I got my confirmation letter stating that my application is accepted and being transferred to California Service Center (CSC).

My fiance is from Syria, and she still lives there.  On December 4, 2017, the Supreme Court approved Trump's travel ban. my questions are:

 

  1- Does the ban effect K1 visas? If so,

  2- Is my application on halt and not being processed due to the ban?

  3- Does any one know if this travel ban is going to continue?

  1. Yes
  2. AFAIK, no....they will still process cases, but cannot issue visas unless the CO determines that a waiver for the ban is appropriate.
  3. Whatever deity you believe in (if any). Nobody else can know what the courts will decide or when they will do it.

I would seriously read up more.  I encourage you to read posts from others who are indeed experiences issues.  To say it won't have any effect or that nothing exists is not fully accurate.

The question that begs, 

What if my application was processed and approved, but no visa due to the travel ban.  Would my case be awaiting until the ban is removed, expired and not renewed; or set on the shelf and expires and when, in future, the ban is removed I will need to re-apply?

I don't think any one of us can answer that for sure.  All you can do is read the posts from the search page I posted above.  From the first EO of trumps that I read...no visas for certain categories are being issued for those countries.  You may very likely sit in AP for quite awhile or until it is resolved.
