The speeding ticket = arrest thing is driving me bananas.  Because generally a traffic ticket is not an arrestIf you were not taken to the police department and booked, then you were not arrested. BUT I just read that in SOME states it is!  For example, if being pulled over for a traffic offense, under Washington law it's an arrest. It's not a custodial arrest, but it is an arrest.

So I guess it really depends on your state and how they view those kinds of things.  As someone that never got a ticket (touch wood) I totally learned something new today!

I guess the issue is that the question also includes citation. So technically, anything can come under citation category. Its complicated further because in the instructions they say that you dont need to produce anything for a ticket under $500 as long as it doesnt involve lacohol/drugs or bodily harm. So yeah.

And thats amazing! haha I have been driving for 9 years now, I consider 2 minor under 100 dollars tickets to be decent. But I might just be too nice to myself lol

Guys, I have been filing my taxes for the past 3 years. For the 2 years before that, I was a student who wasnt working and was being supported by my aunt/parents. I therefore did not file any taxes for those years as I had no income. That should be fine right? Any thoughts?

My N400 form does reflect that I was going to university full time during that time as well.

Tax returns must be filled whether or not there was an income.

When arrest (or placing under custody) is made, police must state the words "I'm placing you under arrest". You cannot be placed under arrest (custody) not knowing. Also when you are placed under arrest "Miranda" rights must be provided.

If you really want to know the fine-line, call a civil rights lawyer, pay for 15-30mins consultation and the answers will be well worth the time and money.

If police stops you and gives you a ticket (for minor traffic infraction), that's not an arrest; for a simple reason: you must identify yourself; when you provide DL, the police knows where you live and can issue you citation. If you refuse (!) to give DL, THEN police can arrest you and take you to the station.

This process, combined with 2 mistakes I made on the original n400 are giving me anxiety (mistakes are saying "No" for ever been arrested, etc..because I got 2 speeding ticket. Second mistake being that I answered "NO" on whether I did not file taxes. I filed no because I didnt NEED to file taxes but apparently you have to say yes and then attach an explanation saying that you didnt make any income, etc). Both mistakes were honest but I am still going to see a lawyer soon to put myself at ease and just for them to review my application and point out if there is anything else that is not aligning before my interview.

I hope I am the only one in this situation.

Your first mistake is not necessarily a mistake. N400 asks for "citations, arrests, detention...etc given by law enforcement officer".. A speeding ticket is a "citation" so technically your answer should have been "Yes", but applicants are not supposed to be legal experts, and the guidance is vague since instructions say that you dont need to bring evidence of traffic tickets for less than $500. This leaves room for interpretation and this has been discussed in United States Supreme Court Case in June 2017.

 - Nobody expects you to be legal expert. Bring proof that you paid tickets and if you are asked present them.

Your second mistake, is a mistake. Everyone must file taxes for various reasons (proof of residency, public burden, marriages, alimony, etc....).You must file taxes, even if you earn zero dollars. I don't know what happens in this case - ask immigration lawyer.

You are certainly not correct. You're not required to file taxes if your income falls below a certain amount (depends on the minimum and the standard deduction for specific year). You're certainly not required to file taxes if you have no earnings whatsoever like I did.

My mistake wasn't not filing taxes. My mistake was failing to answer "yes" and providing explanation.

Please do correct me with source if I'm wrong because I'd genuinly like to know where you're coming from .

Tax returns must be filled whether or not there was an income.

Waiting and genuinely curious where you are getting this info from. Every website I have seen (including IRS) says that you are not required to file tax return if you made below certain amount.

If you are a student hoding F1 visa, you don't have to file tax. Once you become a PRC, you have to file tax. Even you don't have income. That's what I understand for that.

This is where I am getting this from. I am still curious to find out where it says you are required to even if you dont have income.

Guys I need your opinion:

I was checking my application last night and I found out the following mistakes:

1- I did not enlist one of my employment .

2- mistake in date of residence it was September and I put October.

3- I have mistakes in schools dates , I found out school mistakes when I requested school enrollment history.

Note: I`m still in line for interview...do you think this will cause them to give me (( the decision not yet made, they`re not gonna approve it )))

what I have to do?

Thanks

I think your mistakes are minors. And remember the backlog is huge now if the officer makes your case pending meaning he/she creates more work for them and even their managers. I don't think they want to be in that situation.
