Have you updated the tracking sheet? I couldn't find your name on either of the May 2017 tracking sheets. When did your send your package, when did you do your biometrics etc? This will help us provide you with some answers to the questions asked.

Good to see things moving along swiftly for most, congratulations!

 

Am I the only IOE from May filers?  I have only heard bad things about the cases processed by IOE... shucks!

I didn't fill out the tracking sheet yet but all informations are on signature....

I did not e-file (as in upload any documents online, I sent a physical package with a G-1145 for electronic notification), my NOA1 came back with a receipt # starting with IOE, I guess it was routed there after delivery in Dallas.

What is the rason for things going to IOE?  I'm not super clued up on what the difference is, does someone mind explaining to me?

All I know is receipts that start with IOE are processed by the ELIS (e-filing) center, which last year caused many cases to be delayed for months.  Perhaps since that happened, very few people were filing online and cases are being sent their way to help other centers' workload.

Their policy can be a bit confusing, and sometimes lead to different standards. Really have to focus on the choice of words. Specifically read the section on the name check itself:

 

C. FBI Name Checks

 

The FBI conducts “name checks” on all naturalization applicants, and disseminates the information contained in the FBI’s files to USCIS in response to the name check requests. The FBI’s National Name Check Program (NNCP) includes a search against the FBI’s Universal Index (UNI), which contains personnel, administrative, applicant, and criminal files compiled for law enforcement purposes. The FBI disseminates the information contained in the FBI’s files to USCIS in response to the name check requests.

 

The FBI name check must be completed and cleared before an applicant for naturalization is scheduled for his or her naturalization interview. A definitive FBI name check response of “NR” (No Record) or “PR” (Positive Response) is valid for the duration of the application for which they were conducted. Definitive responses used to support other applications are valid for 15 months from the FBI process date. A new name check is required in cases where the final adjudication and naturalization have not occurred within that timeframe or the name check was processed incorrectly.

 

If you got a definitive "name check" answer (NR/PR) on your N400, its good for the duration of the app - weather it takes 1 month or 100 months to adjudicate. Fingerprints are valid for 15 months, so it they can't get an answer from the FBI in 15 months - you have to submit new FPs. We hear about this every now and then - N400 applicants still waiting have to go in for a 2nd bio session. 

 

On the other hand, and here's the different standard, a NR/PR answer from a another application is valid for 15 months from the date of processing, if it is to be applied to another application. And the other application must be adjudicated within that time from. And since the Agency can never guarantee a turnaround time, I think they must charge for the service, even if they don't end up using it (which seldom happens).

 

In my case - I did my ROC FPs on 6/24/2016 - so they are valid to 9/24/2017. Its very unlikely  that my case has its interview scheduled prior to that, let alone the oath. If it does, I'd be ecstatic. But I'd rather them start on the biometrics ASAP than wait till 9/24, find out I'm not done, then add delay to get the biometrics done.

 

I would assume only a few people would fall under the 15-month period - the examples are pretty old, given new processing times - maybe even less. If it happens - consider yourself lucky. Seems pretty clear, no refunds are given, perhaps in case they had to process. On the other hand, and what happens more frequently, applicants needing round 2 of biometrics don't have to pay an additional fee. So the approach seems reasonable to me.

There were some horror stories back around the turn of the year with the IOE apps. But they seemed to be limited to applications that were re-routed there. Since Jan - the IOE apps that were e-filed have been adjudicated maybe 1-3 months faster than non IOE apps. I heard there was a whole process overhaul on the electronic system, so its moving through a lot faster. If I knew about the option, I would have e-filed myself. We discussed this here:

 

Alas - I found out too late! Anyway - with the process overhaul, I think the IOE apps should be better - so good luck to you!

I am finding myself frustrated with the fact I'm getting so annoyed to be stuck at bio stage still 4 weeks on. The only positive I have is lots of numbers before me are also still not in line so it must really just be a workload issue for them. 

At this stage the NBC still has our files right? Or is all of this dependent on how backlogged our field offices are?

I purposely did the e-file last week hoping it would move faster than the NBC route. Could it possible that USCIS had fixed their ELIS issues? (What am I thinking?!)

 

But alas, two roads diverged in the woods, and I took the one less traveled by.
