Hello,

On the I-864, Part 6, point 2 it reads:

My current individual annual income is: _______

 

I am currently unemployed (left work a month ago as I prepare to move back to the USA), so is my current annual income zero? In the form instructions it provides the following guidance: "For purposes of this affidavit, the line for Total Income on IRS Forms 1040 and 1040A will be considered when
determining income."

So can/should I put in the total income stated on my 2016 1040 into the box asking for my current individual annual income

 

This number would then be repeated on the next page for point 19.a under Federal Income Tax Return Information.

You are mixing 2 things here.

 

The first part - Current Individual Annual Income is added up towards the "Item Number 3. - 17. Current Annual Household Income. This section is used to determine the sponsor’s household income."

As it says on the form itself: "Current Individual Annual Income. Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided. " This is your current income and yes, it is zero if you are unemployed. I goes on to say you can submit evidence of this income, since you are unemployed you do not have this.

 

The part (Total Income) you are quoting "For purposes of this affidavit, the line for Total Income on IRS Forms 1040 and 1040A will be considered when
determining income." relates to: "Item Numbers 18.a. - 20. Federal Income Tax Return Information"  They are saying that this will be considered - not that it is the income that you are using to meet the requirements. If the current income is different from your total income on your last return, then the items will also differ. 

 

In many instances it is the opposite way that the current income is higher than the last return (pay raise, new job etc) It is then up to the sponsor to supply enough evidence that  supports that income as opposed to the line 22 from the last return. In your case - you don't have any evidence (paystubs employment letter etc) that the income from your last return is also your current income.
