I need help on what to do next? sue them to make a decision?

My I-130 form was recived on April 1st 2016 at the lock-box in Chicago. Priority date is April 1st of 2016 in august 2016 I received request for evidence. I replied it. I than checked the online statues I found this as statues (On August 5, 2016, we received your response to our Request for Evidence for your Form I-130, Petition for Alien Relative, Receipt Number YSC1690038536. Our Potomac Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.) Since than nothing. I called them many time and they keep telling me to wait 30 days and 60 days. I even requested several case service on why its taking so long to make a decision or expedite my case. All they will tell me is that the case is being processed please wait 30 days to 60 days. To this day I am still waiting. I am waiting over a year for a decision. Anyone know why it would take them this long? The case at Potomac Service Center in Arlington , Virgina.

Unfortunately, nobody knows why it is taking so long.

 

You can try to involve your congressperson. Suing would be futile. There is no law saying they have to be done by a certain amount of time.

 

Longest AP I have seen was 4 years.

You are well beyond normal processing deadlines. You need to take the following actions immediately:

  1. Call them. Ask to speak to a Tier 2 representative and tell them you're application is well past normal processing and you want to file an inquiry.
  2. File an inquiry on the USCIS website. 
  3. Contact you local congressperson and senators. They can inquire about the status of your case.
