TIMELINE

31 May 2016 - legally married in Estonia, just the 2 of us
27 July 2016 - wedding ceremony & reception

 

USCIS Phase

08 September 2016 - I-130 sent to USCIS Chicago Lockbox (FILED FROM ABROAD)

14 September - I-130 received at Nebraska Service Center

16 September - NOA1 via e-mail

29 September - notice returned to USCIS because the Post Office could not deliver it

22 November - NOA1 finally received in the mail (in the US)

31 March 2017 - NOA 2 via e-mail, app and USCIS website

3 April - NOA 2 received in the mail (in the US)

11 April - Case Was Sent to Department of State

17 April - Case received by NVC

20 April - NVC case number assigned

21 April -  DS-261 Completed Online
25 April - Welcome e-mail received, AOS fee paid

Hello,

This has scared us a little bit. I assembled our packets before leaving the US to come back and live with my husband as we wait for this NVC process to be completed. Then we will go to the interview together.

Now, my mom has our packets, and she is going to add our barcodes and write our case number on each page for us. However, must she really put everything in order as this second page "Document Cover Sheet" says to do?

It's better if she does that because it's way easier for the person reviewing your documents. That way they can easily tell if you have everything/if something is missing. She should assemble them in that order, especially since the welcome letter specifically says so.

Thanks for the advice. We appreciate the quick response.

Now we have some more questions:

1). I am the petitioner (USC). I was married and divorced before meeting my husband. Should I include my divorce records where is says marriage termination? Or is that only for if my husband was previously married and divorced?

2). Which civil docs do they need from me in the Affidavit of Support section?

 

3). Would my birth certificate which shows my mother's name who is also our joint sponsor be enough as proof of relationship?

4). I have my car insurance, driver's license and bank statements with my home address which is the same as my mother's. Is that also good for proof that we are in the same household?

5). I have compiled an entire separate file just for my proof of domicile, since I am now living in Uganda. It has all the things that show my address, my letter of employment and reinstatement from my boss showing that I will have a job when I return, and a letter of intent to re-establish domicile. So now do I need to make duplicates where proof of relationship with joint sponsor is required? Or will it be okay, and will they find it alright, if it is just in the Proof of Domicile file?

To answer your questions: 

 

1. Yes, include the divorce decree in the civil documents packet. Make sure your husband brings the original to the interview. This is from NVC's website: 

 

If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

  • Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
  • Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

2. AOS only includes financial documents, no civil documents.

 

3. Yes. Are you also sending in your mom's tax returns? Are you listed as a dependent on her tax return? That's not necessary but it could also add up as further evidence.

 

4. I'm not sure about this, but it seems like a safe assumption. 

 

5. Are you asking about providing some sort of information that you have an ongoing relationship with your mother while you are away? I don't think you need to send in anything regarding that.

As you can see in this screenshot of the AOS form, those are optional. 

 

Yes, bring photocopies of the tax returns to the interview.

Oh, I feel you! I was visiting my husband when we received our case number and I was going to be there for another week at that time and the only document that was missing was my police certificate. I felt so bad that it set us back a whole week. But the first thing I did when I got off that plane...I went to a police station and got my police certificate.

Did any of you receive RFE's? If so, for what and how long after scan date did they send an RFE

When I printed out my completed i-867 forms, the barcode was just a blank gray block on some pages - I have no idea why. Would we be penalized for this?

No check sheets (RFE) etc. yet! :ph34r:

 

Same thing happened to me with the I-867 though, so I scoured the net searching for a form that would have it. Somehow I found one last year and lucky saved it, because I could not find it again online. I use that one to file our AOS last month. It stores the information you are typing so that it makes it easier for them to scan the info in, that is all.

 

I have read on VJ that people who send it without the barcode has not had issues (think about the people who fill it by hand), specifically due to the barcode, so we should be ok... :whistle:

 

Here is an uneventful yet speedy NVC journey for us all!
