I just don't understand USCIS at all,I'm awaiting our NOA2 and the things you read about on here and other forums is ridiculous. You send in all the evidence they require such as pics of meeting within the past 2 years and other such items and people still get Rfe 😡 😡 😡

I really cannot wait for this to all be over and I can plan my future with my fiance.

Posted (edited)

Pictures are secondary evidence of meeting within the past 2 years. It's incredibly difficult to confirm where the photo was taken, when it was taken, and that it has not been altered. More basic things like boarding passes, passport stamps,. receipts, etc. show a person, date and location together.

Don't get me wrong...I'm also often surprised by some people getting an RFE for evidence of x, while others had no issue with the same type of evidence.

Well..that's not always like that. In my case it took really long to come (NOA2) but i got approved right away. For them to send the RFE has to have a reason (not enough evidence or there's something that doesn't make enough sense to them). I sent flight tickets from both of us (him coming to me and me traveling to him as well as vacations we made together to other countries), hotel booking where both of our names can be seen, the stamps on our passports so they would see the dates that we got into the countries (as proof that we actually did get in), pictures not just of us but of us with his family and my family as well as us in vacation to other countries.

I will advice you to be extremely patient at that point as that's all you can do on NOA2 stage. Keep contact with your fiancée, support each other and you both could always visit each other (just make sure to have all the proof so they see that you're going back to your country). My fiance came to my country back in February for a week and there was no problem and since he left we have been supporting each other and trying to keep ourselves busy.

Keep it up!

Exactly how can evidence be good enough for one application and not another it's baffling beyond belief 😔 I sent all my boarding passes and copies of airline tickets but no passport stamps as on my first 2 visits CBP didn't stamp my passport only on my visit in February just before we filed our K1, also sent a few receipts and my bank statements or purchases I made whilst in USA with my fiance. All the photos we sent are genuine I wouldn't dream of doing anything like using fake pics that would destroy my case and future.

We are visiting each other twice more whilst waiting for NOA2 😀 fiance is coming to UK 2 weeks today for 9 days 😅 we sent in her plane booking confirmation along with our K1 visa application March 2nd 2017, plus I am going back to USA for the fourth time July 1st for independence day week 😁

Not forgetting filling in my I94 travel history on the k1 application itself as proof that I entered USA and didn't overstay.

Unfortunately each country is different, there are countries that are very high fraud and the cases get examined with a magnifying glass and get RFE'd for minor things.

The UK is low fraud and generally cases get completed without many issues.

I was unlucky, I got an RFE for missing paperwork that was never missing!!

So you just sent in paperwork again

Yes my divorce absolute was 'missing' so we fedex'd a fresh copy to them, we knew the first one was there because we both did a tick and compare list before we sent the packet, anyway..............................

We waited and heard nothing, so my wife called to find out the problem, yes they had received the new paperwork, but it was not what they required, they required my divorce absolute...................!!???

So my wife (not known for her patience) made them read out the paperwork they had received and suddenly a bell went off, yes they had got my absolute.......................!! For those of you who don't know and American absolute is like a file of impressive paperwork, whereas the English one is a raggy piece of A4! They had the paperwork all the time, just didn't know what it was!! All that bull***t took 6 months to sort!

USCIS does have rules, and then they have discretion on certain levels.

Note that discretion doesn't only exist at this I-129F stage, but at the interview as well.

And yes, some people get RFE'd for things others don't.

I know when I did our I-129F and our statement about meeting, I put that we met online, but not where. I didn't get an RFE, but a girl who had filed around the same time who put the same thing did. The only difference is, is that I had met my husband online in 2010 (5 years before filing), and then seen him in person multiple times for a couple of years before filing, while their relationship was more recent. It's possible that any extra proof I had sent (along with plane tickets, passport stamps, and hotel reservations), eased any worry that we met on an IMBRA site.

With all this said, the I-129F is without a doubt the easiest part of the process. Try not to focus all your energy into this, or else you may have a hell of a time later when there's a lot more involved, and when USCIS can scrutinize a lot more.

Different folks, different strokes. The adjudicating officers have to make judgement calls constantly, and some will put more credence on certain types of evidence than others. The requirement is that the 2 people have met within the past 2 years, which is a clear rule for them to go by. However, evidence showing that requirement was met differs in every case and they have to use their discretion.

I wasn't suggesting in any way that you didn't send genuine photos. I'm saying there are people who fake photos and documents, and they have to take that risk into account with anything they review.
