Hi guys. I just need help. Our petition date is November 22, 2016. Can we just get a hint of what is the current status for the filing in this month of May? How long is it going to take? What are the exact procedures if you known any. Please. Me and my husband were clueless.

If the classification (F2A- Spouse of legal permanent resident) is correct, here is information from the visa bulletin. F2A is not an unlimited category, so it may still be a little while, as they are still processing cases from 2015 as visas become available. 

 

You can find this information on the visa bulletin  section of the travel.gov website.

Depends on the country you're in. The visa bulletin updates every month, that will give you the most updated information on how they are processing your case. It also depends on the service center that it went to. There are a lot of factors, but the visa bulletin will be your best bet for tracking purposes.

As of the moment I just want to know if the USCIS Processing Times is accurate one? It says there that I-130 for a permanent resident filing for a spouse/child under 21 is processing cases  of August 23, 2016. What is the difference of this data to the Visa Bulletin?

While USCIS may accept your case and you can submit documents to the NVC, you will still have to wait for a visa to become available because F2A is not an unlimited category. The visa bulletin shows you the last priority date that is "current", aka any application with an application priority date prior to the date listed on the bulletin has a visa available to them. Unless you're petitioning for someone from Mexico, it is 15 July 2015, a year and 5 months from your priority date, which means there is a year and 5 months worth of people waiting ahead of you for a visa. There are some cases sitting at the NVC from 1994, just waiting for a visa to become available. It's unfortunate, but it is reality. Before we married, my wife was in the F2B category, it would've been over 20 years until she could've immigrated to the US. If the legal permanent resident is eligible for citizenship, it may be quicker to go that route, because a spouse of a USC is an unlimited category and you can upgrade your priority once becoming a citizen.

No, there is no estimated time because you need to wait for a visa to become available for your visa category. Your priority date (Found on NOA1) is 22 Nov 16, but visas are only available for 15 Jul 15 and prior, meaning there is a 1 year 5 month gap between your priority date and the priority date that has visas available. It is difficult to estimate time because it depends on the number of applications that are between your priority date and the priority date in which there are visas available.

Do you have the list of steps so that we can know if we are on the right track. We received our 1st NOA. I wonder when are going to receive the 2nd and what are we going to do next after that.

I don't have a list, I know there are checklists somewhere on this forum. I know from experience that you will receive an acceptance or denial, if it is an acceptance they will send you NOA2, then they will forward your case to the state department (NVC) and then you will receive instructions from there. You will send the documents, pay your fees, etc, and if all of this is done before a visa becomes available for you, then you wait until your priority date becomes current.

For your type of Visa category they are currently processing July 2015, it means that probably you will wait at least a year and 5 months before reaching NVC stage (if you get approved), but is not easy to set up a real estimated time.

And your timeline says you get your NOA1 in December, so your priority date can't be November ?¿

It is November. It is what indicated in our Status and and letter.
