Just get married and file, no need to tell them in advance. :)

That's why I said a simple wedding as well because once that individual is out of status then they are deportable(more than likely won't happen) but it is possible until you file for the AOS paperwork.

No, you do not have to tell them that your going to get married. Just ahead and do it.

True, true, although marriage is a very special day for the couple ^^

That's what I meant to say yesterday but alas I was on my phone and did not feel like typing 1000 characters. But you are correct it is a special day, but if she is more worried about him leaving then go ahead and do it then do a large nice Renewal of Vows later.

If we got married, how quickly would we have to co-habitate? I'm sure there's no written rule about this, but any thoughts? I wouldn't want immigration to think this was a sham. But houses in our city are extremely expensive, and we're not in a financial position to buy a house yet.

Buying real estate is not a requirement. You can live in any kind of residence, owned or leased.

So you're not living together? Why does he want to stay? If he's not living with you what difference does it make where he is - the US or his home country? Marriage visas and family-based green cards are granted on the assumption that the couple wants to live together or the family wants to be reunited. USCIS will seriously question the validity of your relationship if you don't live together. With all due respect, it will look like a marriage for paperwork.

Hi all, 

 

I'm new to VisaJourney :)

 

My boyfriend and I currently both live in the United States, but he has to go back to his home country because his visa is expiring. I am a U.S. citizen and he is not. We are considering getting married. Would it change the process significantly if we married abroad vs. marrying in the U.S.?

You are both in USa, so you can marry and then file the petition, no waiting time. If you go abroad. Then you have to wait till the end of the process to live together. Only will be allowed to visit you without the intention of staying.

How long before we should be living together (regardless of ownership)?

I think we need a little more detail.  Is he here on a student, visitor, or some other visa?  What are your living arrangements now?  Can you get an apartment near where you plan to live at a reasonable cost, or can you live at your parents until you can afford something?  I agree with JFH as USCIS will ask these questions in the AOS phase, and if you aren't living together, this may pose some challenges.

There have been couples in the past here on vj that have had problems with AOS or even ROC because they live in completely different cities, USCIS saw that as a problem and correctly questioned the validity of their marriage.
