I'll be arriving in the US on a K-1 visa in June and filing for Adjustment of Status soon after. I've already been offered a part-time job at the local Assessor's Office for when I arrive and was hoping to use this to get my EAD expedited. My would-be employer has sent me a mock-up of a letter for me to send to USCIS as evidence of my job offer, which I've replicated below, and I was wondering if anyone could tell me if it looks sufficient.

 

RE: [MY NAME]

 

TO WHOM IT MAY CONCERN:

 

I have offered [My Name] a part-time job working in the Assessor's Office immediately upon his arrival in the United States.

 

Sincerely,

 

[Employer's Name]

[County] Assessor

 

The actual letter will be printed on their official letterhead and everything but I'm wondering if there's any more information I should ask them to add to it, or whether what they've said above is enough.

 

Also, what sort of evidence should I be sending USCIS to prove "financial hardship"? A lot of the information I've seen so far is very vague. My fiancee is self-employed and only just meets the sponsorship requirement for AOS so would it be enough to just include her tax return to show that she doesn't earn much?

You might be able to put the letter to the EAD application when you file for AOS. If possible, ask your future employer if he can give you a copy of the signed work contract as evidence.

Surely I need to wait for my EAD before I can legally sign any work contracts?

Send in the AOS/EAD/AP petitions and await your NOA1. Once it is in, call the USCIS and ask for an expedite on your EAD.

Yes, you have to wait for your employment authorization card BEFORE any work contracts.

 

As for expedition of your EAD... Usually you have to have a receipt number (NOA1 of your I-765) to be able to expedite, along with a reason (pending job offer in your case)

^ correct. Plus sending an employment offer letter with the EAD application is not going to work.

I'm aware of how and when to submit an expedite request, I'm just asking if the format of the letter I posted above will be sufficient as proof of a job offer and if there's anything else I should send in with it as evidence.

The letter looks ok but it'd be better if the employer states when (s)he wants to hire you.

They've said "immediately upon his arrival in the United States", would it be better to put some arbitrary date in there just to make it look more concrete?

I would suggest putting a desired start date, position, full/part time status, and permanent/temporary status as well. I would also suggest having it being written/signed after entry into the US (since the expedite can't be submitted until after AOS is filed), and therefore use updated wording (i.e. killing off the "immediately upon his arrival" section).

I would not use the sentence 'immediately upon his arrival' since that is kind of impossible too. I'm seconding what Geowrian says; Let your future employer write everything down and hand sign it.

I sent a Letter along with a job offer, where I explained why i think it will be a hardship for me if i miss that employment.... 

 

If your request to expedite your EAD is accepted, USCIS will send you a letter (via e-mail or regular letter - it's a random. My son received a regular letter in 5 days, I - e/mail the next day). you will be given a fax number and some other info and directions... Just follow what the letter tells you to do.

 

Also, documents from your possible employer should be submitted with an official letterhead..
