I-864 Part 6 #2 when leaving job

Greetings everyone,

 

I have searched for answers here, but it seems no one has had the same experience as me, or at least hasn't written about it yet.

 

On May 17th, I will be leaving my job to return to my husband's country, and I will stay there until he has his visa in hand. This is going to be for no less than 6 months. 

 

The question #2 on part 6 of the I-864 says, "My current individual annual income is:". I have absolutely no idea what to put. My income is actually going to stop, so should I just put an estimate of what I have made so far this year?

Yes, I have a household member combining income with me...i just hate to put $0 because it will look like I haven't been working. I already read through those things but didn't get any clarifications.

I guess I can put what I have made so far? I doubt we will be back in the US before November, and I never have the luck of getting a job in just one month. So I will just tally up what I have made so far.

 

Are we sure this is ok, though? I am so worried of getting it sent back because I will be unemployed by the time the I-864 is submitted.

• #1. It is anticipated income, not what the sponsor paid in taxes last year.  The I-864 in Part 6, line 5, asks the sponsor to indicate his or her “current individual annual income.” This phrase is key and every word is significant.  “Current” means what he or she anticipates earning this calendar year.  That may be easy to calculate in December, but more difficult early in the year.  So be prepared to ask your client for proof of what he or she is currently earning and likely to have earned by the end of the year. “Individual” means only report what the sponsor himself or herself is planning to earn, not what the sponsor and his/her spouse are earning jointly. “Annual” means what the sponsor is likely to earn this year. This figure, supplemented with any additional household members’ income on Part 6, line 10, will determine if the sponsor’s income is sufficient for his or her household size.  If the anticipated income is more than they paid taxes on last year, then include proof to support your estimate, such as pay stubs and a letter from their employer. Finally, “income” includes both taxable and nontaxable income, including certain federal or state benefits.  For example, include social security retirement or disability, as well as unemployment or workers compensation.  But do not include Supplemental Security Income (SSI) for the aged, blind, or disabled, and do not include Temporary Assistance for Needy Children (TANF). In addition, do not include interest income.

In other words, if you stop working, your expected current annual income is what you have made thus far and not $0 (unless you have no reported income for which you will be filing taxes for next year).

 

if you're using a joint sponsor's income to meet the requirements, whether or not you are employed is irrelevant for the purpose of the I-864 as long as the income satisfies the financial requirements.  NVC is mainly concerned with whether the intending immigrant will be a public charge.  

 

As for whether or not it gets sent back...just make sure you include the correct forms and accurate information , especially when it comes to household counts, and that any income numbers match tax transcripts/returns.  There's always a risk NVC loses paperwork or sends a false checklist so just be well prepared and keep your fingers crossed.

Eh, I doubt we will be submitting in May. We haven't been approved for our I-130 yet. October 13th is our priority date. Nebraska is so insanely behind, and our expected dates of approval just keep getting pushed further and further back.

 

I have to prepare everything now though, because I am going back to Uganda on the 17th of this month. My mom will add the cover letters and barcodes and mail both NVC packets for us. It is so nerve wracking to leave such a crucial step in the hands of another person. I have faith she will do fine, though.
