221g given to us; how long will it take?

we had our interview on tuesday (may 2nd), and were given the 221g denial page indicating we had to turn in my husband's Household Registration (taiwanese) and proof of domicile.  the HHR is easy to get here, so i asked our interviewer (who was quite nice) how long it would take if we sent it in immediately, and he said they just need to review, and "a couple of days is all"

 

when he asked about my proof of domicile, i mentioned to him that i already turned in a full packet of the proof (voter registration, driver's license, all my banks/credit card statements, letter of employment indicating that because i work for a missionary organisation, i am stationed overseas - this was listed as one of the ways that i can prove my domicile is with a letter from my missionary org).  anyway, that was all turned into NVC, which was also sent to the embassy here.  i told him that it should be in the packet, if not, then i have an exact copy of the packet on me (i showed it to him).  he said, oh, well then maybe it just hasn't been reviewed yet.  he told me to just write an email to AIT (the embassy here in taiwan) and let them know that it was already included.  

 

my question is - why was it checked off on the 221g if they hadn't even bothered to review it???  

 

i am also wondering how long it usually takes for them to review the paperwork handed in.  he told us a couple of days, but if i'm being honest, i don't really trust any of the visa-related people.  hehe.  anyone have any experience with this?

hi all,

i just checked our visa status online, and as of today (last updated) 5/5, it still says it is "refused"

 

sigh, i don't know what to do anymore.  i am in shock, and at a complete loss, and it has taken over a year since we started this application.  i don't even understand why we were refused??  my husband does not have a criminal record, we provided more than enough pictures and letters and proof of relationship.  he's never applied to go to the US before, so there is no history there either.

 

is there anything i can do?  is there a way to find out why we are still refused? they still have not returned his passport, either, but i'm guessing since we're refused, they'll be returning it to us soon.

 

i just want to cry. :(

yes, i have been here in taiwan since 2006 (with only about 1.5 years away in australia, and then in the states).  the domicile thing really irked me a bit, since i was 26 when i left the US, and at that age, there was no way i could have owned a house or property!  this is what i included on my letter regarding the proof of domicile:

 

steps i have taken to maintain US Domicile:
- maintained my texas voter registration

- maintained my american expresse credit card registered in the US

- maintained an active bank account at the bank of america

- maintained my texas driver's licence

- maintained my US retirement fund through envoy financial (via employer)

- maintained my automobile in care of my parents

 

supporting documents for the above:
- letter of employment

- voter registration card showing permanent US address

- american express credit card statement showing US billing address

- bank of america bank statement showing permanent US address

- copy of texas driver's license showing permanent US address

- retirement fund statement showing employer's US address

Thanks for the info 

I think I might have a lot of problems in the interview since I have no proof of domicile since I came to Taiwan right after finishing high school so theres no way I will have any proof :( I dont know if its better to just go back to the US first without my husband

After you got approved at NVC how long did you have to wait to get the interview date?

Sorry I have another question while you werent living in the US did you pay your taxes? since you been gone for a long time. Thanks for the answer

only one week.  we received our case complete from NVC on 3/23, and then on 3/30, we got another email from them that had our interview date on it.

and yes, i have always always always paid my taxes!  you can always backfile; not sure how to do that, though.  can probably google and figure out how to do that.  for your I-864, you'll need to have tax transcripts, so you should probably start back-filing your taxes now, so that when you get to the i-864 stage, you will actually have tax transcripts to request for!

so domicile is the problem that concerned the AIT? 

From all the stuff you listed seems like you have more than enough evidences to prove it

do you think is because you been out of the US for too long? (I have been in Taiwan for 4 years...)

Did your husband bring any prove of savings or make it seems like y'all planning to leave?

well, i felt like i provided more than enough to prove that i am still domiciled in the US, but just working overseas.  so we suspected if there was an official refusal of visa, that that might have been it (since nothing else seemed reason enough to NOT give it to us!)

 

but no matter, we just checked today, and the ceac website says it is issued!!!  finally.  

 

and to answer your other question, nope, my husband did not have to prove anything financially.  they just want to know that i can support him financially! (in our case, i had to ask my brother-in-law to be our joint sponsor).

Congratulations!!!  I checked our status today, and ours is "ISSUED", too!!!!  Only took 1 day for AIT to receive and review the divorce certificate from the 221(g)

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi cusci10, May I ask how u resolved your 221g  proof of domicile? You see I also got 221g proof of domicile last week . I really dont know what document to send them . They told me I have to go back and get a job or lease a house.Can you please share with me your experience.. cause Im getting so confused and sad cause I'll have to be away from my kids to do that..thanks

I haven't had my interview yet until 2 weeks and i am worried about the domicile too

i will try to gather as much as info as i can and hope i can prove of my intent to leave 

i will show emails that i have applied to jobs, and colleges since i want to go back and study also shipping receipts of stuff we already shipped also voting info to prove i voted in the last elections

Also my husband will explain our  situation but i dont know if that will help much 

If this doesn't work i guess i will have to leave with out my husband :(

whats this ur only solution for domicile? go back to the US and find a job? :o
