Hello all,

 

I will be sponsoring my husband for his AOS from a K1 visa and I am in a bind of whether or not my evidence is enough. I do know there's always the option of a co-sponsor but that is difficult to come by and I would like to send out my packet ASAP so my husband can get his EAD to work as soon as possible.

 

My situation:

I started my current, permanent, full-time job in December 2016 so I have been working for 5 months. I make well above the 125% poverty line so my annual salary is enough to support my household of 2. I obtained a letter of employment from my employer on company letterhead stating my start date, permanent position, and annual salary. I can also provide pay stubs for the last 5 months. However, my tax returns for 2016 are well below the poverty line since I was going to school/doing an internship abroad. My 2014 and 2015 tax returns are well below the 125% poverty line because I was still a student.

 

Even though I make enough to support my husband now, will it be a probably since my tax returns for the last 3 years don't show that I make 125% above the poverty line?

It's the current salary that matters.

If it isn't difficult, it isn't worth it.

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

Current pay stubs and job letter will work best, although do include your past tax returns as well.

03-19-2021: Officially an American Citizen 🇺🇸 Entire journey from initial K-1 Visa filing to Naturalization took 5 years, 8 days.
