@gkcoachadam

Ours went faster than we expected. I think things move quicker in the fall because less people applying from what I ended up reading. Ours took about 7 months but I think we could have tried to get it down in 5-6 months if we wanted to be as fast as possible. We rescheduled our interview once and my husband rescheduled his medical appointment to try and make the timing work because of our wedding. It worked out in the end!

Honestly the K1 application was probably harder than the AOS because of what they required for proof of relationship and visits with your fiancé.

We took a chance and planned a wedding to fall within our approved 90 day status. We actually had to make an effort to slow the process down a little as to not have the medical expire before entry. It happened I was visiting during my now husbands interview (but we both had to fly to Sydney for his interview because that is the consultant location).

It's more frustration not knowing anything,, and no set timeline on it.

Im lucky cos my work visa is still valid so I'm still working, GC I'm not to bothered about currently just want the EAD so I can switch jobs

Congrats. I wonder if they might be moving up the case. Someone on one of my other forums I follow on VJ said they are looking to putting a stop to AOS from a tourist visa in 2018  even with Marriage (you said in your first post that you are transitioning from a tourist visa) Maybe they are pushing you through because of that rule change.

i saw this elsewhere too but iirc it is only for consular processing so it wouldnt apply unless they do a complete and retroactively applied overhaul of determination of intent upon arrival for tourists under vwp

Thread is moved from the "AOS from K1/K3" main forum to the Case Progress subforum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

hey guys, I got an email from USPS with a photo of the letter from USCIS, but I cannot figure out what the letter is about. It is coming from the main Lee's Summit office. Can someone please advise if you got the letter for the interview, where was that letter sent from? from Lee's Summit or a local office? thanks!

I am not completely sure but consular processing is for applicants currently living abroad and applying for permanent residential status. If the person currently living in the US he/she is going through the adjustment of status process and not the consular processing. These are two different processes (?).

The tourist visa or Esta is a contractual agreement with the person using it and the country with which they are entering. I know my, now husband/then fiancé, has been pulled out of immigration twice while entering the US with requests for return airline tickets and having to show proof of employment in Australia to prove he was only entering as a tourist, and that he would be leaving the country within the contracted time of the tourist visa allotment.

But in either case it sounds like your case should be fine you just might get some extra questions at the GC interview regarding the marriage since a K1 visa was not obtained prior to the marriage but it is currently still allowed by government standards. It sounds like in 2018 it will become much more difficult for immigration from a tourist visa.

From what I have red and seen on other VJ threads, the 90 day EAD no longer applies, it's going to be a frustrating wait

I have seen even EAD Expedites are taking 3 weeks now (a year ago they were taking about 7 days).  In the June AOS 2017 thread people have started receiving their EADs without expedite so there is a little glimmer of hope.

You said you were currently employed but need it by Nov. 18th.

If I were you I would get a job letter from your Human Resource department and submit it under an expedite for an EAD under your AOS (to ensure you stay gainfully employed and prevent financial hardship/not lose your job basically). I would then back up your request with a congressman checking on your request on your behalf and resubmitting that paperwork to the congressman in your region.

My current work visa expires on the 18th and I can stay employed once the EAD comes, doing the same job that I do now, which I have held since 2012 all on work visas.

I am going to give it 1 more week and than I'll submit.

I will get a letter stating that they continue to employ me and the salary that I will be receiving.

I got my EAD without expediting, but it took 107 days in total. I applied on May 24th. It took exactly a week from my case status being updated on line to receiving it in the mail.

I applied for AP on July 25th. I have a travel date of November 2nd (which I didn't have when I applied). I got an Infopass Appointment a week or so ago. I explained I now have a travel date and wanted to expedite. The guy basically said it was too early to expedite and I should come back in the second week in October. Visajourney estimate of when I could receive my AP is now after November 22nd, clearly too late for me. So I will make another Infopass asap and hope for the best with my expedite request. Seems on here as though expediting is taking a long time too, so I don't hold out any hope really. I fear I'll be caught by being too early to expedite this month and too late next month! All the guy could tell me was it was all in hand. If it took 90 days, I would have it in time, but I am very worried that it won't.

He also checked my AOS and said it was still with MSC and hadn't been sent to Baltimore yet. I have been 'ready to be scheduled for interview' since June 29th. He just told me the stats as on the website, that they were processing August 2016 apps as of end July this year. Seems to be advancing about a month every month. I don't expect an interview until 2018 for that now.

No worries! I was approved on 7th Sept and it came on the 14th.

Have you filed for EAD and AP together? I didn't but of course wish I had now! My AP file date is the day before yours.
