I advised her to ask her lawyer if it was okay.  Why shouldn't she take that advice?  I didn't tell her to tell CBP.

That's what it seems like. I am just an observer. You are going to go in front of an immigration officer to tell this same story and hopefully he/she sees it different from how i see it.

You are desperate!

go back and read your own post. You said you will have no where to stay. Where would you have gone if it wasn't for this boyfriend?

You have a lawyer lying to you that you can come and stay..forgetting that your boyfriend is not FREE to marry. That's what the law says. He must be free to marry. Until his divorce is finalized, he isn't free to marry.

So you are counting on waiting it out here << possibly overstaying your visa, in hopes that he won't change his mind and you two can marry.

I thought it was folks from 3rd world countries that are desperate to come here.. Not my business but that's how your story appears to me.

 

Wait in your home country until he can marry you , then he can file for K-1  for you to come. It isnt that difficult to get one from your country, even with this your story.

As I said: you clearly haven't read the complete post, because I never said that I want to marry while he's still in divorce trial. All I asked if there were other ways, and stated what his lawyer said to me. If the lawyer is wrong it's not me to blame, thank you. And if I really did it for convenience, then I would have chosen a man living in a better country and having a better job. Thank you.

Coming and marrying and staying and filing for AOS isn't illegal.  The intent to do so is what creates a problem.  If the adjudicator at some point decides that intent was there, it would create a problem.  If the adjudicator doesn't believe there is intent then there's no problem.  The fact that OP stated that intent here is problematic, but ultimately whoever will review the case at some point down the road will make that determination, not the posters piling on here.

 

Come to the US on VWP, without intent to marry.  Spend up to 90 days together, see how you feel.  If at some point you decide to get married during that time, then great, get married and apply for AOS.  Just don't make the decision to do that in advance.
