Hi all. I hope title is clear enough. I met my boyfriend back in early 2016, and became more than friends during that year. We've seen each other last time in early 2017 while he visited my country (The Netherlands). I want to live with him in the USA, but with a Visa Waiver I'm not allowed to stay in the USA longer than 90 days (please note: I've never been in the USA so far). Sadly he's still in divorce waiting period, since some states have that weird long waiting periods. Waiting wouldn't be a problem, but I need to leave my house in two months because of expiring contract deal. The divorce will probably not be done before that period. I have nowhere else to stay, so I want to settle with my boyfriend in the USA. Are there any other options for us left? Is getting a tourist visa an option for example? What are the requirements for that? He earns enough money with his job to be a sponsor for example. I'm looking for work too, but sadly no success yet finding a job that would sponsor me a work visa.

I hope somebody can help me, thank you very much in advance.

If you apply for a tourist visa  and it is denied, then you will not be able to use ESTA/VWP afterwards.

Thank you, JoJo. Is there really no other way to "extend" my stay until he's divorced, so we can officially marry?

To get a work visa, you would need a US employer willing to go through the process on your behalf.  This can take years.  

 

To get a student visa, you would need to have international student tuition and proof of a foreign home that you intend to return to.

 

There is no volunteering visa.

 

If there was a way for you, we would tell you.  There isn't.  The sooner you accept this, the better you can plan for the separation.

I know you're asking about coming to be in the States with him, but that would be very difficult. Any chance he could come and be with you somewhere outside the States? I came to be with my fiance outside the States during the K1 visa wait. It's very difficult and hard to survive at all sometimes, but at least you'd be together. Just a thought. I wish you guys luck! <3

Please also note that if you come to visit and the intention is to stay until he's able to marry you so that you can stay in the US without leaving, that is visa fraud.

Visit first - a lot can happen in 90 days... if you still want to be with him...  you can return to Denmark and by then hope his divorce is complete so he can apply for K1....

As others noted, you can visit under the VWP. You cannot stay in the US. You will need to return home to do the medical, visa interview, etc.

 

There is no extension for entry under a VWP. You technically could do a tourist visa for a longer stay in the US (before returning home), but it's usually a decently difficult process for a VWP program. A denial would likely jeopardize your ability to travel via an ESTA. Personally, it seems way too risky when you have the ability to visit pretty easily (relatively) for 90 days already.

 

There is no sponsorship for a tourist visa. That's a common myth. COs don't really care about why you're coming to the US so much as they care about why you are compelled to leave it.
