status between i751 and i797C if CG expires

Hey guys,

 

I am going to file the i751 soon with my wife however I have a couple of concerns. For some unforeseen reasons we have not been able to file it yet and there is a possibility that my Conditional Green Card will expire before I receive the response from USCIS for the extension of my GC as it usually takes 2-3 weeks after filing. What happens to my job in such a case? Do I have to notify my employer? Or should they do that? My GC expires at the end of May. Am I going to be illegal and unauthorized to work between the expiration of the GC and the extension of GC? I work in a big technology retail store. Can I get into trouble if nobody says anything and I continue to work in the gap of the expiration of my GC and the start of the extended 1 year GC? Can they fire me? I am also reluctant to say anything because what if otherwise nothing would happen. Thank you guys!

Send your I-751 by courier so that you have proof of delivery, at least, before the expiry of your conditional GC. 

As long as you apply before your card expires, you will never be out of status (even if you don't have the letter yet). In the unlikely event that you are asked for proof of your legal status during that gap, you will have to (patiently, since no one really understands it) explain the situation, and that you're expecting the extension letter any day. You are not responsible to notify anyone of anything until and unless your application is denied (unlikely, and no decision will be made for about a year, at the rate they're going). If your application is denied, then and only then will you be out of status.
