Hello, 

 

My spouse application for ROC has been granted and given 1 year extension for VISA and Work Authorization and within 2 weeks my spouse attacked me and tried to strangle me. My spouse is currently pending criminal Felony charges for domestic violence from a previous incident. My spouse is not in the home due to acts of violence toward me with the most recent being him attempting to strangle me. The new charges from the DA's office have not been filed yet, even though he has a pending 2 felonies.   I am moving forward with legal separation. My questions are: 

 

1. Who protects the US Citizen from domestic violence from an immigrant? The local District Attorney's office? The DA's office claims that they are not responsible for reporting these charges to ICE. 

2. What can I do to inform USCIS or ICE of these pending charges? 

3. The spouse also has a drug and alcohol abuse and suffered from a stroke resulting in drug abuse. I have ER records to support this, if I submit this information to his employer, will I still be responsible to support him if he loses his job?

1 - The police.

2 - You can send a letter to USCIS or ICE.

3 - What is the purpose from submitting such evidence to his employer? Think about it, him having a job is peace of mind to you.

There are 2 existing Felonies a criminal case has already been lodged against him. 

 

He attacked me even though he already had a pending case. 

 

ICE said until he is convicted no red flags will be made to USCIS. 

 

Doesn't matter really. I live in CA. He is protected and has more rights than I, a US citizen and he has the money to pay for a lawyer to get out of his trouble.
