I have a question about marrying in Mexico.  I have been reading all sorts of information online that yes you have to wait one year after your divorce to marry in Mexico.  But then have read that some states in Mexico have no waiting period.  Or that it depends on the judges ruling.  I just got divorced in the USA but it hasn't been one year yet.  My fiancee and I want to marry in Sonora and then wait two years before filing for the spousal visa which is another topic for another day.  My plan is to work in Nogales,Tucson or Yuma and then live in Sonora across the border while we wait for two years.   

 

Does anybody know for sure what the requirement is in Sonora,Mexico for divorced people?  Or if this is just a law for Mexican nationals divorcing down there?  My decree doesn't have any sentence of "i have to wait one year before remarrying on it".

Here are the requirements for Sonora:

 

In Sonora, only civil marriage is recognized as legal.  People wishing to get married in Mexico may also have a religious ceremony but this religious ceremony will have no legal implications.

Marriages are performed by the “Oficina del Registro Civil” (Civil Register Office) for a fee around 600 pesos, marriages can also be performed elsewhere for an additional fee.  The Civil Register’s Office can tell you the amount of the fee.  There are Civil Register offices in each city or town throughout Sonora.

You must present the following documentation at the time of your wedding:

  1. Marriage application (obtained at the civil register office) including a statement as to whether you will marry under joint or separate property
  2. A certified copy of your birth certificate translated into Spanish and Apostilled
  3. If divorced, a certified copy of the divorce decree also translated into Spanish and Apostilled
  4. Blood tests (they have to be done in Mexico, civil register will provide more info)
  5. 2 legally qualified witnesses.  The witnesses must be over 18, present at the ceremony and have valid government-issued identification.

Additional notes:  In Sonora, a tourist permit is no longer required.  Divorced people cannot marry in Mexico until one year after the divorce decree is obtained. People under 18 cannot get married without parental consent.  Copies of marriage certificates are available at the Civil Register Office where the ceremony was performed.

Interview: 21-February-2017   We scheduled our own interview because we had an approved medical expedite with the consulate. By sheer luck we got such a quick interview date because someone cancelled their appointment less than 20 minutes prior
Interview Result: Approved!!
Visa Issued: 21-February-2017     Visa issued same day as interview
DHL tracking information received: 22-February-2017     DHL tracking number appeared 28 hours after interview, scheduled for delivery the next day
Visa in hand: 23-Feb-2017
US POE (Minneapolis): 26-Feb-2017

I ended up marrying in Sonora in July 2017 after officially concluding a long divorce in Maricopa County, Phoenix in late April 2017.   I had no problem getting married in Sonora for not waiting one year.   In Mexico City it might be different.  I would not know what to tell you.

How do they even know you were previously married that you need to provide the divorce papers?

 

I'll be doing the same but in Guanajuato and I have the same concern, hoping it ends up being the same.

I did see they require a Certificate of Non-Impediment which maybe will show the previous marriage.

Honestly, I don't think I ever mentioned it LOL!  My father in law has an attorney friend in Sonora and he advised my father in law that it wont be a problem but there is no need to be bringing it up.  I didn't provide any divorce papers to the judge in Magdalena de Kino, Sonora.  I only had to submit paperwork for my divorce to USCIS during her green card application period.  And quite frankly that is all that matters.  Maybe it might come up if you ever apply for residency in Mexico but even then they don't have all this computer data in Mexico on people's backgrounds like the FBI and CIA has here in the states.

That's what I figured. As long as I have the official document saying that I'm not married.

I'll have the papers Apostiled just in case since I'll need to have the other documents done anyway.

So in Guanajuato they said we don't have to wait 1 year.

They also told us we can translate the documents in Mexico, they has a list of authorized translators, and I'm sure it's WAY cheaper than here in the states where I've seen prices like $20 per page.

 

I did get the certificate of impediment and it shows that I was married before and divorced, it asks you on the application and it's best to be truthful.

Either way I have certified copies already so I'll just need to apostile everything.
