Hi guys! I hope someone could help me here especially VJ users from the Philippines. My sister recently applied for a tourist visa and got denied unfortunately. She was an intern last year and she's been home for 7 months now. There are a couple of red flags in her situation because she is a single 23 year old and was a J1 visa holder for a year with a valid SSN. She is the only one in our family who does not have a tourist visa and we are planning to spend Christmas together here this year since I now have a baby. 

 

My questions is, how soon can she apply for another visa? Will it hurt her if she tries again in a month? Any tips on how to approach this situation? 

 

Also, do you guys think that the fact that my Mom is currently here in the US as a tourist affect my sister's chances? I mean I am just thinking that maybe the US Embassy in the Philippines was able to track that my Mom is here and she is trying to obtain a visa?

 

I love reading experiences from other visa interviews especially ones that are similar from our situation so if you have something to share please post it here! :)

Your sister can apply gain whenever she wants.  If nothing changes in a month for her, you can expect the same results.  Unfortunately, there is little that a young unmarried Filipina can do when denied a tourist visa.  Your mom being in the US does not affect your sister.  

 

Your sister needs strong ties to overcome the presumption that all tourists want to immigrate.

Thank you so much for your response Jojo92122 :) It's just challenging because the consul did not really tell her why she got denied (just like majority of the B2 visas that get denied). She told me that he started by saying "due to the US law now, we are much stricter in giving out visas". Hopefully it's not the end for her! We are thinking positive and hopefully we can find a good solution to make her situation better once she applies again. 

 

It's also tricky because she works with my Dad now at our company. We also kind of think that the US Embassy might think that she is doing "nothing" because it's a family company.

Yes. They actually asked her why she has a Shenzhen visa. She told the consul that she was a flight attendant before.

Your mother is in the US on a tourist visa trying to obtain a GC?

She can apply again as soon as she wants to, but unless something changes in her situation what caused a denial the result will be the same - another denial. Since she has some possible red flags she needs to think if there is any way to work out at least some of them or wait until they change and may be work on gaining more ties to the homecountry. Myself I wouldn't apply any earlier than 9-12 months after denial and only if my situation actually changes, otherwise it will be waste of time and money.

I think here was a topic by someone who was applying for tourist visa over and over, like 5 or 6 times but since situation of the applicant didn't change, all visas had been denied.

Okay thank you for the insight. The situation is tricky because they did not really say why she got denied. She got asked if she's married, has a child, abd why she has a shenzhen visa.
