I-130 (CR-1) process immigration for married (wife)

Hi,

 

My case was also at Nebraska Center. We filed it through our lawyer, they were really extremely helpful. The process took almost a year (like 11 months something). I kept checking the website to get any updates of my case and they're very up-to-date. After been waiting for months and no update about whether my case was completed or not, I asked my husband to call NVC, took 45 minutes to finally get through to the agent, and asked about my case. The agent said it's completed but he had to call them again in a week because they didn't have the date for the interview. I have never received any notification email about it, some people did. After a week, my husband called the NVC again, same process, was on hold for 45 minutes, it's crazy, and we finally got the interview date. The next morning I received an email confirming my interview date. I had to wait more than a month for my interview, some people were lucky and got the date sooner.

Will the process become fast if we hire a lawyer? How many months did you guys wait before your interview? 

I'm sorry, I didn't have the chance to reply you last night. I don't think that matters because lawyers can't force USCIS or NVC to complete the case quickly. Me and my husband had a very crazy schedule and the time zone difference didn't help, we couldn't even find the time to talk to each other every day, so we decided to hire a lawyer. Pro: having a lawyer was really helpful because they did everything for us. When I got the interview date, my lawyer sent all the documents to Indonesia, all organized and I just had to put them into folders. Con: they're expensive.

 

Our priority date was on January 25th, 2016, case completed on November 3rd, 2016. I got the interview date on November 10th, 2016 and my interview was on December 29th, 2016. Visa in hand was on January 4th, 2017. It was such a long journey but I know that there are people who had to wait longer than me so I can't complain.

Okay I understand what you have said and I'm very thankfuk that you replied. I just want to ask, you are an LPR right? Your husband is US Citizen? So you are saying thay your PD was Jan 2016, you were interviewed at Nov 2016, your visa was available Jan 2017. Are in US now? My husband is an LPR. PD was Nov 2016 and it will take us years. Can I qualify for an CR1 visa? Mine is F2A.

Yes, you asked me twice lol. I am Lawful Permanent Resident, my husband is US Citizen and he's an American. Why would it take you years? I hope it's not gonna be long for you. And I don't know that you're qualified for an CR1 visa or not. I read that you could upgrade.

The only way to "upgrade" is if the LPR becomes a USC during the process,  as the F2 then changes to a IR/CR1 and a visa becomes immediately available, but still needs to be processed. 

Ah, I didn't know that. To answer your question @matchabby, I applied CR1 visa right after me and my husband got married, and I'm a LPR now and I've been living here in states since January 19th, 2017, two weeks after I got my CR1 visa (I forgot to answer that). Now I understand why you said it would take years, that's crazy, I hope you can live together as soon as possible.

5. COPY OF YOUR W2's for each year.
6. Letter from your Employer (stating your position held, salary rate, if permanent or temporary)
7. You can also include copies of your bank account statements (esp if you are self-employed)
 
*What to mail for the Immigrant Visa.  Just send copies of the following documents applicable to the beneficiary.
 
1. Alien's Birth Certificate
2. Court and Prison Records, if any
3. Deportation Documentation, if any
4. Marriage Certificate
5. Divorce Decree of your wife, if any
6. Military Records, if any
7. Photocopy of Valid Passport Biographic Data Page of Alien Spouse
8. Police Certificate for all applicants 16 years old or older
9. Adoption Documentation if any
 
You can send in one envelope all of your documents for the Affidavit of support and Immigrant Visa application.  The address on where to send it will be included in the Instruction that the NVC will send you."
 
The NVC will also give you a checklist in their welcome letter.

This is very very helpful so i can estimate my times as well. I appreciate it. If i can ask you what is the Police Certificate means? does it mean me (US Citizen) or my wife (beneficiary) will need this? i think w2 and tax return is the same thing your listed? that is what I will be getting. Also congrats on your process. how long did you wait between NOA1 and NOA2?

Hi, what RFE did the USCIS send you? was it something personal or just general missing information? i was just curious because I dont even know about that part. and im still between NOA1 and NOA2 on my 5th month with no updates on Nebraska. I am US citizen, does it really take that long for US Citizens also versus an LPR? i just dont know how they prioritized that in the times USCIS received it. Thanks so much! congrats on the visa!!

Hi When you say "faster processing time" does it mean they pick the ones with US Citizen first? or LPR? or does it matter when they receive it even if they receive the LPR first than the US citizen in same months and same processing center?

A police certificate is a copy of your criminal record or a statement that you do not have a criminal record. It will be for the beneficiary. 

 

W2 is different from the tax return. W2 is what your employer gives you at the beginning of the year. Tax return is the official report of your earnings from the government. You can use a tax transcript instead of the tax return. You can find the transcript online and print it out. https://www.irs.gov/individuals/get-transcript

 

My NOA2 took 172 days.

So technically me as the US Citizen petitioner will not need a Police Certificate? I wanted to ask this so I can let my wife (beneficiary) know about this to get hers in her home country. Also Thank you for the link! is it free or better to get them physically mailed? or digitally online?

Correct, you will not need a police certificate, only your wife will.

 

The tax transcript is free. You can print it online or have it mailed to you. I printed mine directly from the website.

So all of this will be after the NOA2 right? the tax police certificate etc...and from how many years back is the tax transcript and W2 they need? Thanks so much this is very helpful! Did you use a lawyer/agency or did it yourself?
