I filed an i-130 petition in September. I received a letter a month later with a receipt number. The status stayed that way until March. For the past 2 months the status says a request for initial evidence has been mailed. But nothing ever came. I check my mail daily. So I called, then waited the 30 days, never received any email or letter. It's very crazy how even a visit to a field office couldn't tell me what evidence they're asking for. I wrote directly to the Potomac center and await a response. In the age of digital communication it's as if they're decades behind.

 

I'm concerned about the deadline to send that evidence. I hope they respond as promised because so far all customer service reps seem to have lied. Hopefully the deadline doesn't pass and they set an appointment for interview. None of my contact information has changed. What do you suggest?

File an online service request on their website. Make sure you indicate that you never received the RFE. Call the customer service hotline and ask to speak to a Tier 2 representative. Ask them why you haven't received it; confirm they have your correct address on file and try to get them to resolve the issue for you.

Have you filled out the SR on their webpage where it says letter not received?

I read 30-90 days but I couldn't find a clear answer for how long until the deadline arrives.

 

Yes I filled that out in late March. I never received an email from that or any notification whatsoever.

You should file again even though they have up to 30 days to respond. 

 

I would do it again, also call a tier 2 and again make an info appointment. My worries for you is that they will deny because they haven't heard anything from the RFE

I was given a call back last week from a Tier 2 representative. They said an email will arrive in 1-5 days. My address was confirmed to be correct. Nothing arrived. Today is the 6th day and I'm trying to call them again once they turn on their "8-6pm" call center. Friday I sent an overnight letter to Potomac center which is handling it. I asked them to contact me and gave my mobile,fax,email, etc. 5/12 my wife's tourist visa expires so I'm praying the lovely border patrol let's her back in for another 2 months so we don't have to rent an apartment in Quebec.

The tier 2 guy seemed just as incapable as the regular reps. I was hoping he could at least send me an email of the evidence needed or fax it to me or have it mailed. He said my question was ignored because the name wasn't the petitioner. BUT IT WAS. I'm the petitioner doing this for my wife, and I only have one name. I don't know how they can outright ignore and come up with excuses. I read forms very thoroughly and clearly. These guys just don't care.

I would just call again the chance of getting another tier 2 is big so I would do that.

 

Your profile says K-3 is it not a CR-1 you are doing?

Also is your wife living here on a tourist visa?

Thanks. Yeah that's what I'm doing. It's 1030am here and their call center still isn't "turned on" to talk to a live person. My wife is a Canadian citizen moving to the US to live with me, I'm a US citizen. But we're brown so we might as well be coming from Pakistan. She is living here on a tourist visa, her 6 months are almost up. Married people like to live together.

Yeah they might like that but it's not legal to live here on a tourist visa. Don't complicate things for yourself.

Last time I showed border patrol our marriage certificate and the letter showing our petition is pending. It seems they can define "living" however they want but it's obvious we're waiting for the visa. If they decide to be jerky I'll have to rent a place in Montreal. Border agents don't make a fortune so I hope they sympathize.

This has nothing to do with the case they have rules to follow.

 

Yes she is allowed to visit you doing the process but just that visit.

Yeah. I check it more than once a day. Hotmail has the search field to find any junk email that contains uscis etc. Next time I talk to them I'm going note all their rep ID numbers and names. It seems anyone can get a job with immigration or US border patrol.

Actually it does because border agents have a lot of power in regard to who can cross. Or who to search ones vehicle or who to shout at.
