AOS interview went wrong. I/O was sure from the beginning that the petitioner was lying.

Hello everyone,

 

Hope you can help me with this one. I filed I485/I130 in September to adjust status, marriage-based.On April 27th we had the interview, the IO was trying to intimidate us from the start, barely ask any questions to me and sent me out. 

Talked to my husband for 30 min, called me back in, ask me 2 questions and sending me back out. 

At the end my husband came out with the RFE and told me that the IO said:

-All peruvian J1s are liars.

-I wont tell you what to bring because you will fake it

-I know how it goes, you guys can be fighting but once the immigration papers come up, she starts to be nice.

-I dont give my number to almost anyone, but I want you to have it, so you can call me when you realize she is lying.

 

Clearly, this IO was not interviewing, but trying to convince my husband that Im lying to him.

 

(1)Infopass and talk to a supervisor would be my only choice?

(2)Am I stuck with the same IO after I send RFE response? I have til July 23rd.

(3)Is stokes interview a possibility? Im pretty sure we could pass with a reasonable IO.

K-1:
06/08/2016: I-129F Sent

06/16/2016: Check cashed

09/09/2016: At the Stockholm Embassy

09/29/2016: Interview date, APPROVAL 

10/14/2016: Visa ISSUED

10/17/2016: Visa received

12/22/2016: I-485, I-131, I-765 Sent

01/10/2017: Check cashed

02/03/2017: Biometrics completed

04/17/2017: Your case is ready to be scheduled for an interview

01/20/2018: I-485 Interview letter received

02/01/2018: I-485 Interview, APPROVAL

wow, I'm sorry that you had that awful experience, did she really said she won't tell you what was the RFE?

 

I wonder if in this case the help of his congressman/representative would be more helpful than a infopass, not sure, but it would be something I would try.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

A Stokes interview is a possibility. Who is the petitioner, you or your husband? Are there any red flags in your case other than the J1 (it's more suspicious in the case of an overstay)? How long have you two been together? What documentation did you  bring to the interview? That might be helpful for trying to figure out what you might need to bring next time, since the IO didn't provide any guidance.

Married to US Citizen. I'm the beneficiary.

 

Adjustment of Status (AOS) from F-1

  • Priority date: 2016-09
  • Initial interview for I-485: 2017-06. Approved on the same day.

 

Removal of Conditions (ROC)

  • Eligible starting: 2019-03
