What type of visa, and who petitions?

I am the USC, wife is LPR, her daughter is 14. Wife has been in the USA for exactly a year now.

 

1) what type of visa do we need for her daughter?

2) who is the petitioner USC or the LPR?

3) If I petition I don't have really any photos of us together, will that even be required so strictly as the IR-1 visa?

 

*** we had to file her daughters BC with my petition for my wife, I am wondering if there is some sort of "follow to join" for her mother's immigration pending that I can just pick back up on, I doubt it. Never hurts to ask though.

Since your wife came on an IR-1/CR-1 visa, there is no follow to join.

 

It would be best if you, the USC, files for your stepdaughter.  It would be an IR-2 case, USC petitioning for an unmarried child.  The entire process will take a year.

 

If your wife files as an LPR, it currently takes 2 years for a visa.  The wait can be longer.

 

The lack of pictures is not a problem.  You do not need to show any relationship other than a legal one with your marriage certificate and your stepdaughter's birth certificate.

Follow to join has to be within 1 year, and doesn't exist for IR-based visas.
