You are very welcome!!

The way things have recently been with USCIS (a massive launch of green cards with wrong dates of residency of them, biometric appointments scheduled to"out-of State locations ) I'm not surprised that now and Tier 2 doesn't help much.... Unspeakable incompetency  :(

Hopefully, another Tier 2 will be more knowledgeable and helpful.

May I ask you?... I see you've applied for N-400... Did you submit the application AFTER I-751 approval?.. I'm already eligible to file, but since my son is on my I-751  - i'm not really sure if I should go ahead and apply or wait it out...

Did anyone on here file their I-751 with a dependent?   I just received my 10 Year Green called but my daughter didn't.  So I called USCIS and they said she doesn't get one!   She got her original CR1 green card, and extension but doesn't get a IR Green Card..... I am extremely concerned about how she travels back into the Country?  She also has to travel without me.

WT actual F?  We're in the same boat as you too.

I did.  They said "she gets it from you".  I said, I understand that but how does she prove it.  They told me they had answered my question and put the phone down!

She gets her citizenship through you, but NOT the green card.  dear lord, where do they find these USCIS employees???

THANK YOU SO MUCH FOR THIS!!!!!!!!!!!!!!!!!!  I am so mad at the agent I spoke to.  He was a Tier 2!   She travels at the end of the month so I will def take her to Info Pass and her extension expires 5 days AFTER she returns to the US so she is valid for entry BUT I hate her not having her GC.  And to keep having to deal with USCIS.   Fingers cross hers just comes but I've had no notice about hers.  I will let you know how we make out.  I have called USCIS again and am waiting for a call back from another Tier 2 agent....

Again, we're in the same boat.  My stepson lives with us, therefore has all his immigration stuff through his dad.  He's currently in London visiting his mother, and will be back just a few days before his extension letter "expires."  We've contemplated having him go to the London embassy to get a stamp there, just in case.  This whole situation is maddening.  As you know, Johan has also already filed for N-400.  As I understand it, once that's approved, because K2 is a minor, he'll just be able to get a US passport on his father's citizenship.    I cannot wait for this process to be DONE.

Ah, I see.... Thank you.

I'm still not sure what to do... From one hand I'd like to be done with USCIS .

From another one, I'm afraid that if a parent applies for N-400  then they could possibly  "loose" a child's I-751... I don't know. This is something new we are experiencing these days - it was not a dilemma before, I-751 used to take 6-8 months to be approved, definitely before a parent was eligible to file for N-400.

I wonder if there are other I-751 filers with children who submitted N-400 while ROC was still pending... Would love to hear their experiences

We are.  Given the gargantuan timeline for i-751 approvals, filing for N-400 once he could seems like it'll speed things along.  I read on these forums that once naturalization occurs, then minors are also eligible for their passports.  Our kid also travels internationally at least once per year, so while it's a risk, it's more of a short term one.  IDK . we didn't really worry about USCIS losing our kid's 1-751.  Maybe we're just optimists (in an unrealistic way, when you consider the ineptness that IS USCIS!).

Thank you for your reply - really appreciate that!

You see, my son is not a minor anymore..  So if I apply for N-400, he won't get his citizenship through me anyway and will apply at his time under 5 years rule.... That's why I'm concerned if I should file now or wait who knows how long until we BOTH have our green cards. After that - he doesn't depend on me (for immigration benefits I mean :) ) anymore.

I'm going to schedule an InfoPasss , in a week or two - he needs another I-551 stamp, I would try to get one for me as well since I'm traveling abroad in August and everything will be expired by the time I'm coming back (a wonderful "combo" of 2-years green card+Ext.Letter).

I guess, will ask this question at InfoPass as well... although during my AOS I learnt two different people there can give you  two different answers.... Grrrrr :( Will be so glad when aaaaaall of  this is over!!!!

ooooohhhhh.  Yes, he not being a minor definitely puts a wrench in the plans!  In that case, I'd maybe wait until you both have new green cards.  Tough call.  :(  Was he still a minor when you did the renewal?  He must have been, I assume.

So I called them back and got a different Tier 2 agent.  She was MUCH more helpful.  She said usually the approval/green card is issued after the parent (like you said) and she would check.  She checked and it showed that her approval letter was issued, even though we haven't received it.  It also showed her Green Card had been produced and she gave me the tracking number!!!  Although the tracking number is showing that it is with our Post Office distribution center...and it has been there since mine was there as well (June 30)....she couldn't tell me any more as it's now with the post office.  Due to the holiday tomorrow, there is nothing I can do until Thursday.  But the good thing is you were totally right and the first agent was TOTALLY wrong and worried me for nothing.  How can an agent not know what information they are supposed to give.  It's crazy.

In regards to the N400.  I applied online June 14, BEFORE I got my approval.  I could have done it at the end of May and I was going to wait but changed my mind.   And my I-751 approval came June 26.   So I really don't know if it made a difference but I think my file was probably on the desk of a I-751 agent by the time I filed the N400.

I just cannot wait for this process to all be done.  Like most of us!!

Good luck!!!

Also, I know she doesn't have to get a citizenship certificate to get the passport but with all the complications I am thinking I may just get it for her anyway so in the future there is no question about her status.  Even with a US passport!

Definitely, get the appointment and have her passport stamped before she travels...even though her extension letter would still be valid when she returns. You never know with those immigration officers at the ports of entry.

Agree!  If one of them is in a bad mood, who knows what they will do!

About Post Office.. Is your girl on the Post Office list under your address?... You see, what happened to us - I got my extension letter after I-751 submission, my son didn't. Then the same with biometric appointment ,- mine was in the mail box, but not his..  I called and spoke to a Tier 2 IO. He was really helpful and confirmed that son's extension letter and biometric appointment notice were sent along with mine, at the same  day.. He even faxed to me son's biometric appointment notice so we, at least, didn't miss it. The IO told me that sometimes Post Office doesn't deliver government letters if a person is not listed under the address. After that I went to a Post office and got iit fixed - they put son's name listed under our address. Extension letter has  never made it to us- was too late and they most likely sent it back and it got lost. But we "caught" biometric notice -  the originall was in the mail box few days after they added son's name on that list.

I was "surprised" we got an issue like that  - we didn't have any missing letters before - he always received his correspondence, no problem, and our conditional green cards and welcome letters arrived together, envelope to envelope..

So you are probably experiencing something similar with your daughter and Post Office keeps the mails.  I'm sure you'll pick girl's green card from the Post Office on Thursday!!!

For those who have already filed N-400 online, I have a question about submitting the Green Card copy if you haven't got I-751 approved yet.

Do you submit

1) The expired 2-yr green ;

 or / and 2) The extension letter;

or / and 3)  I-515 stamp?

Thanks ahead!
