Yes, your lawyer does sound very incompetent.  You need to send both your IV and AOS documents together otherwise they won't start reviewing your case.  You will likely get a checklist because of the missing documents. We had to send ours in two emails because the size of the all the attachments was too big for one email.

Have you checked the requirements for Canada and what you need to send?  Here is the link to what everyone is required to submit.

https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html

Can you not just email the IV documents yourself if you have them all?  I don't think it matter who emails the NVC (that's what I was told last night anyway).

Thanks, I believe he sent all of them in as he has them all and asked for a copy of my birth Cert (I am the Petitioner).

I feel like asking him for a discount on the balance of money I owe him since I have caught a couple mistakes he made and have taught him a few things about immigration processes.  But am not sure if that is appropriate... and I have a hard time figuring out how to say it.

It could be that he doesn't do many Canadian based immigrants, more Mexican and Adjustment of Status cases that are different...? IDK

The sad thing is that we could have simply done an AOS for my wife as she was down here visiting me but we were trying to do everything legally.  She was pregnant and her visa was going to expire too close to her due date to travel.  So she went back to Canada for a bit so she could come down on another visitor's visa over the time of our child being born so we could be together during that time. She was harassed and turned back at the border.  Too scared to attempt another entry, we applied for a greencard and here we are. We have been apart for a little over 10 months now and I am missing a LOT time with my new born daughter (we have been married 9 years and have 3 children, all dual citizens except my wife)

The petitioner doesn't need to send a copy of their birth certificate.  It's just the beneficiary that does.  The petitioner only sends all the AOS (financial documents).  Did your lawyer cc you into the email so you can see exactly what has been sent?  I'd be wanting to make sure exactly what's been sent so you know.  Your wife will need a police clearance too.  I had to get a Canadian police clearance myself as I lived there previously, and it's quite quick to get when you're in Canada.

You've definitely done the right thing by not doing the AOS when she was there.  You would have had a very hard to get past immigrant intent.

My birth certificate was to prove my US citizenship.  Why we used that instead of my passport is beyond me.
He did not CC me unfortunately.
My wife's police clearance is done and supposed to be in there.
He definitely has all the documents listed on the NVC website.

That's good.  Fingers crossed you'll get a CC soon:)

Request for your lawyer to forward you the emails that were sent to NVC and inform that moving forward, you'd like to be cc'd in all future emails to NVC.

IMO, best to have a copy of everything sent to NVC just for personal records.

Looking for insight:

I just called NVC, they said my case is complete but still waiting for scanning, what he thinks is "final review". Does anyone know what this means? He said that it seems like they have all the docs they need.

So vague. Anyone know what this means?

Hhhmm, I would call back again and speak to somebody else.  That doesn't seem to make much sense.  How can your case be complete if it's still waiting for scanning.  What date were your documents emailed?

It's my second person to tell me that. I emailed the docs last friday, 4/28, docs received Monday, 5/1, "case complete" Tuesday, 5/2. Something's weird, right?

Actually, that does sound correct. EP is way waster and our case was received just a few days after we emailed but we got a checklist. Has your CEAC account changed at at all? Maybe start calling and asking for an interview and see what they say😊

If it's that quick, that is awesome.  Keep us posted when you get an interview date.

Still kinda unsure. If it's complete, why does it need to be scanned in? Isn't that out of order?

Well maybe they meant that they have everything they need ready for review?

Visit the following links to check your status:

If it says "At NVC" and your AOS information is missing.. Then yeah, it's most likely a CC...

They said they have everything they need.

My status says:

No action required: Review in process
Immigrant Visa Case Number:  xxxxxxxxxxx

On 2017-04-18, the National Visa Center (NVC) received your Form DS-261 (Choice of Address and Agent). NVC is reviewing this form.
What do I need to do now?
You do not need to do anything now but wait. Once NVC reviews your Form DS-261, NVC will send your agent* a letter or email with next steps.
If your agent does not receive a letter or an email by 2017-05-09 after submitting Form DS-261, please contact NVC by phone at +1-603-334-0700 or send us a question online at: http://nvc.state.gov/ask
*An agent is NVC's point of contact for your case. This could be you, a relative, friend, immigration organization or lawyer. Your agent needs a reliable email or mailing address that is checked regularly. We will use these address to send information about your case. Your agent is expected to respond to instructions and requests for items that we send in a timely fashion.

AND I am missing the AOS.

Go figure.

Most likely you're under review for now and about to have a CC very soon. :) I would call once your status changes to "At NVC" to confirm a CC and interview date..

Regarding scanning, not sure what they meant about that because you emailed your documents in, if they confirmed receipt of your documents, that's your "scan date".. And it's def clear by your status that they have your documents because your status is "No action required: Review in process"

Regarding the ds-261 message, if you already paid the AOS and ds-260 fees... it's most likely a default message.
